Kim Geun-sik (52), who has been serving for 14 years for sexual assault on 11 young girls, will be released after finishing his sentence in September next year. There are already voices of concern everywhere in society, but it has been confirmed that he has not been included in the registration of sex offenders, increasing anxiety and controversy.

Kim Geun-sik was charged with violating the Act on the Punishment of Sexual Violence and Protection of Victims (Rape, etc.), and was sentenced to 15 years in prison at the first trial in November 2006. Lee’s brother has been finalized and is in prison.

After the Cho Doo-soon case, a court order to disclose personal information becomes possible.

When he was sentenced to 15 years in prison, the current personal information registration system and public notice order system were not in place.

The personal information disclosure system was introduced in 2000 when the Juvenile Sexual Protection Act came into force. At this time, the’National Youth Committee’, not the court, decided who to disclose personal information. Those who were convicted for sexual offenses such as buying the sex of adolescents, such as prostitution and prostitution agents, were targeted.

In 2005, information on people concerned about recidivism, such as those who were sentenced to two or more jail sentences for rape and forcibly harassing young people, and were executed, were required to register and view information on recidivists. At this time, it was the Ministry of Health and Welfare, which absorbed the National Youth Committee, to determine the target audience.

Only after the Jo Doo-soon incident in 2008 was convicted of sexual offenses against children and adolescents in accordance with the Act on Sexual Protection of Children and Adolescents (enforced on January 1, 2011) and the Act on Special Cases concerning the Punishment of Sexual Violence Crimes (enforced on April 16, 2011). The court can now order the disclosure and registration of the person who has been judged.

When Kim Geun-sik was sentenced to a sentence in the court, the court could not decide to disclose and register his personal information. For this reason, Kim Geun-sik can come to society without any restrictions once he finishes his sentence.

In response, the Ministry of Justice believes that Kim Geun-sik can be registered as a sex offender in the future. It is judged that the registration of sex offenders is possible if the deliberation function of the’National Youth Committee’ is utilized, the personal information disclosure and registration system applied to Kim Geun-sik at the time.

Currently, the’National Youth Committee’ is reorganized and operated as the’Youth Protection Committee’ under the Ministry of Gender Equality and Family. The Ministry of Leisure is in charge of managing the sex offender notification(e) site, and is also in charge of managing offenders who have been ordered to register and public notice by the court.

The position of the leisure department has not been decided yet. An official from the Ministry of Leisure said, “It is the Ministry of Leisure’s responsibility to register personal information about past criminals,” but said, “We are reviewing with the Ministry of Justice and receiving legal advice on whether the Leisure Department can function.”

From May 2006 to September of that year, Kim Geun-sik was sentenced to 15 years in prison at the first trial for sexual assault on 11 underage female students from 9 to 17 years old in Incheon and Gyeonggi areas. After that, he appealed but was dismissed and his sentence was confirmed.

It was investigated that he lured the victims with words such as “Please help me with heavy luggage”, put them in a van, beaten them, and raped them. In particular, after being sentenced to 5 years and 6 months in prison for sexual assault on a minor in 2000, he again raped a female student after 16 days of release.
