After the US International Trade Commission (ITC) raised SK’s hand in a patent lawsuit filed by SK Innovation against LG Energy Solutions (formerly LG Chem), LG’s request for cancellation of sanctions was dismissed, and the airfare between the two sides changed. With this ruling, attention is paid to whether some kind of change in position will occur in the negotiations for the’infringement of trade secrets’ between the two companies.

ITC rejected LG’s request to sanction a patent lawsuit filed by SK Innovation against LG Energy Solutions on the 2nd. LG’s request was only a one-sided argument, and the reasons for the patent case were that SK Innovation’s documents were well preserved.

SK Innovation, which was sued by LG for infringement of trade secrets in April 2019, filed a lawsuit against ITC in September of the same year, claiming that LG infringed its patent. Accordingly, in August of last year, LG requested ITC to drop the lawsuit on the grounds of’deletion of documents’ related to the infringement of SK’s trade secrets. However, ITC rejected it. ITC is scheduled to issue a preliminary ruling on the patent lawsuit filed by SK on July 30th.

As SK, which was concentrated in the corner, succeeded in reversing, the battery industry is paying attention to the possibility of accelerating the negotiations before the two companies’infringement of trade secrets’. This is because the gap between the two companies is known to have reached trillions in the amount of compensation they want, and this ruling could significantly narrow the gap.

Prior to this, ITC decided to ban the production and import of some of SK’s lithium-ion battery cells, modules, and packs for 10 years in a lawsuit for infringement of trade secrets filed by LG in February. In ITC, SK has 11 fields from LG. They infringed on 22 trade secrets, and because of this, they thought that they operated the business more than 10 years ahead of competitors. As a result, SK is in danger of paying a large amount of compensation to LG.

However, with the victory of this patent lawsuit, SK’s bargaining power is expected to increase further. On the other hand, if even this lawsuit was won, LG, who was able to secure a clear victory in the negotiations, would have to revise its negotiation strategy as unexpected results came out.

An official of SK Innovation said, “This lawsuit is separate from the trade secret infringement lawsuit. I will prove it.”

An official of LG Energy Solutions said, “This lawsuit was rejected as a request for sanctions to close the case early as a matter for the request for sanctions. We plan to prove it sufficiently.” The position is that there is no particular discussion on the possibility of linking the negotiations for’invasion of trade secrets’.
