SK “No verification” LG “Recognition of results”
Regarding the infringement of battery trade secrets by LG Energy Solutions and SK Innovation, the US International Trade Commission (ITC) announced in a final opinion on the 5th that SK clearly infringed LG’s trade secrets.
According to the final opinion released on the day, ITC confirmed the preliminary decision to lose (early) against SK Innovation and issued an order to stop the infringement of the import ban and trade secrets. .
ITC recognized 11 categories and 22 trade secrets that LG claimed to have been infringed based on the evidence of LG Energy Solutions. ITC decided that this was the subject of a legal remedy order, and said that the period for the US import ban was also set to 10 years in agreement with LG’s assertion.
ITC pointed out that “SK would not have been able to develop the information within 10 years without the infringed LG’s trade secrets.” In this regard, SK Innovation said in a statement on the day that “ITC has never actually verified LG’s alleged infringement of trade secrets.”
SK Innovation said, “We plan to actively address the problems of the ITC decision in the presidential review process and strongly request the exercise of the veto.” LG Energy Solutions urged SK Innovation to accept the results and come to an agreement with a sincere attitude.
