US ITC “Daewoong unlawfully acquires Medytox strain… Based on the results of genetic analysis”

Medytox officials said,’We will hold Daewoong to the end, who thoroughly abused the public and government authorities with shameful lies.

[테크월드=조명의 기자] The full text of the final judgment of the US International Trade Commission (ITC) has been released. As a result, Daewoong’s criminal charges were revealed.

Biopharmaceutical company Medytox (CEO Hyun-ho Jeong) released the full text of the final judgment of the United States International Trade Commission (ITC) announced on December 16 (U.S. local time), and ITC claimed Medytox’s allegations of theft of Daewoong and Ebolus. The committee announced on the 14th that it had been accepted. Based on this final decision, Daewoong and Ebolus’ botulinum toxin formulation’Jubo’ (Korean name Nabota) was banned from importing to the US for 21 months, and sales in the US were also stopped.

The ITC committee admitted that Daewoong had stolen the Medytox strain, saying,’The genetic data are virtually convincing evidence, and based on this, it was confirmed that Daewoong’s strain was derived from Medytox.’ In addition, he reaffirmed that Daewoong’s assertion was a lie, saying, “Daewoong is consistent with the inconvincing claim that he discovered a botulinum strain in soil in Korea that is not related to the University of Wisconsin, but now does not claim that he found it in the soil at all. Daewoong claimed to have found strains in Korean soil for a long time, but the ITC investigation did not reveal where they acquired their strains at all, and even though genetic investigations revealed suspicion of theft, Medytox did not provide enough evidence to prove it. It repeats only meaningless claims that it is not possible.

The ITC Committee also pointed out Daewoong’s unscrupulous arguments and the act of distorting evidence derived from the investigation process. The committee criticized Daewoong’s unreasonable claims that the administrative judge rejected the request, saying, “Daewoong distorted the evidence related to the genetic test of the strain and did not request access to the Allergan strain”. Daewoong has argued that’the preliminary judgment is an obvious error’, saying,’There was a request for access to the Allergan strain, but the administrative judge refused it.’

Medytox’s stealing of manufacturing process technology was also confirmed to be Daewoong’s obvious criminal activity, without any doubt. ‘

An official of Medytox said, “Daewoong stole the botulinum strain and manufacturing process technology of Medytox, and the truth that the product was’jubo’ (Korean name Nabota) was finally revealed by a fair judgment of the US government agency. Even after being confirmed, they are distorting the truth with their own victory, but with the full 74 pages of the ruling released, Daewoong’s argument was settled with an obvious lie.” “The fact that there is no content supporting Daewoong’s innocence in the judgment proves how obvious and certain Daewoong’s criminal activity is,” he said. “This ruling is an unscrupulous lie that Daewoong’found a strain in Korean soil.’ It turned out that he had thoroughly joked with the public and government authorities for a long time.’

Medytox is confident that the same conclusions as ITC will come out in the lawsuits in progress in Korea. Medytox will disclose the allegations of Daewoong’s crimes and request the prohibition of the use of Medytox strains and manufacturing processes and the return of rights, and plan to dispose of products that have already been produced or in circulation, and to make a reasonable claim.

An official of Medytox said, “The criminal acts of Daewoong, who are unreasonable, were revealed through various scientific evidences during the ITC investigation process,” and said, “Based on these data, we expect that the domestic courts and prosecutors will draw the same conclusions.” Although I disagree with the Committee’s judgment that the strain of Medytox is not a trade secret, Daewoong is not entitled to steal the strain and manufacturing process of Medytox, even if it is not a trade secret. He stressed, “We will hold Daewoong to the end, who is deceiving the public with false claims.”
