“Tread over it and step on it”…檢, Jung-in applied a crime of murder of abusive wool

The prosecution was charged with murder by the mother-in-law of Yang-woo, who was accused of abusing a 16-month-old adopted child, Jung In, for several months, leading to death. On the 13th, the prosecution applied for a change of the complaint at the first trial of Jang, who was handed over to the trial for violating the Special Cases Act on the punishment of child abuse crimes (child abuse mortality).

At the trial held at the hearing of the 13th Criminal Division of the Seoul Southern District Court (Judge Shin Hyeok-jae), the prosecution said, “After the prosecution as a child abuse homicide, we conducted a reinforcement investigation.” As a preliminary prosecution for child abuse fatalities, I am applying for a change of the prosecution.” The prosecution explained, “The gist of the changed prosecution was that the accused was aware that if the accused continued to exert strong force on the victim’s abdomen, which was being abused, he could die, and he applied force to step on the victim’s abdomen with his feet.” The basic guidelines for child abuse and lethality recommended by the Supreme Court’s sentencing committee are 4 to 7 years in prison and 10 to 16 years in prison for murder.

Last month, prosecutors accused Jang of child abuse and fatality because it was not revealed in what kind of shock the abdominal injury caused by Jung In-yang was caused. The prosecution said, “We investigated using profiling techniques, but the result was not received due to the outbreak of Corona 19 in the southern detention center, and the prosecution was prosecuted as child abuse on the last day.” I said. Her adoptive wife, Ahn Mo, was handed over to trial on charges of acquiescence (child abandonment and neglect) despite knowing that Jang was abused and Jung In-yang’s health condition.

Jung In, who came to the Jang couple’s house in January of last year, died on October 13th, 271 days after her adoption at a hospital in Yangcheon-gu, Seoul. During the nine months of living with their adoptive parents, pediatricians and child care teachers discovered the abuse and reported child abuse three times, but the police and child protection agencies reportedly returned it without finding evidence of abuse.

Jang’s side denied the allegations of murder and child abuse, saying that neither was intentional. Jang’s lawyer argued that “I admitted to the assault, but there was no intention of abuse.” The victim’s left clavicle fracture, right 9th rib and left 8th fracture, etc. were partially admitted, but “there is no fact that he fractured the occipital region by striking the back head or fractured the right sciatic bone by striking the right foot.” Denied the facts. Regarding the abdominal bleeding, which was a direct cause of Jung In-yang, “there was the fact that the stomach and the back area were pushed like a hand, and the fact that the feelings toward the weakened child were full, grabbing both arms, and dropping it with pain from the aftereffects of chest surgery. However, there was no fact that the pancreas was severe enough to break.”

However, in response to the prosecution’s request for verification of the cause of death, it is known that the autopsies submitted a statement stating that “the wool must have recognized the possibility of death. The Korean Pediatrics and Adolescents Association also recently responded to the prosecutors’ opinion that “It is appropriate for findings such as pancreatic amputation to be applied to the’intentional crime of murder’ or the’unwritten intentional murder’.”

The defendant also claimed that the charges against her husband Ahn were unintentional. The lawyer admitted some of the prosecution, saying, “Although I knew that the victim’s body was weak, I did not provide nutrients in an appropriate way or take any action for the victim,” but for not restraining Jang’s abuse or separating him from the victim, “Mr. Jang said I believed that I would nurture it my own way, and I didn’t deliberately neglect it.” Regarding the suspicion of causing pain by holding Jung In Yang’s arms and clapping her hands strongly, he said, “I tried to use that part because I liked it and laughed when I clapped.” Regarding the reason for not taking Jung In to the hospital, he said, “I didn’t think that I would recover even if I went to the hospital. I thought it was important to feed well at home, and I didn’t plan to leave it deliberately.”

In front of the main gate of the Seoul Southern District Prosecutor’s Office this morning, dozens of citizens, including members of the Child Abuse Prevention Association, gathered and urged the defendant to be severely punished. Citizens who visited the site despite sub-zero temperatures and icy roads condemned their adoptive parents by holding pickets that read “Jang ○○ is a murderer,” “An ○○ arrest,” and “Apply the crime of murder.” Choi Mo (43), a self-employed person, said, “As a father raising two daughters, I came out so angry,” and said, “I wish the perpetrator was punished appropriately.”

Citizens held their seats throughout the trial and continued protests. At the end of the trial, one audience cried out, “Jang ○○, save this evil-like × ah, Yul-ha (renamed name of Yang Jung In)”. And threw things together. Mr. Ahn, who requested personal protection from the court in the morning in a disabled state, waited in the court for about 30 minutes until the police came up after the trial was over. Citizens raised their voice to the court inspector, “Let’s see your face,” “I should have kept Jungin, why are you protecting the murderer?” Citizens condemned by throwing snow at the convoy car leaving the court after carrying Jang.
