The’Kim So-yeon recording file’ received by the reporter? Park Beom-gye

The civil lawsuit filed by Justice Minister Park Bum-gye against former Daejeon City Councilman Kim So-yeon is sparking a controversy over’conflict of powers’. In response to Candidate Park’s claim for damages equivalent to 100 million won, saying, “Attorney Kim So-yeon damaged her reputation by spreading false information,” Attorney Kim filed a civil suit of 300 million won against Candidate Park and three broadcasters on the 2nd. The reason that the lawsuit between Candidate Park and lawyer Kim took place is because of the transcripts submitted to the court in early 2019. The transcript was part of a recording of an interview with reporters from three broadcasting companies in Daejeon, when lawyer Kim raised suspicion of illegal election funding for candidate Park in 2018.

Attorney Kim argues, “At the time, candidate Park obtained the recording file and then extracted some of the contents that were favorable to him and submitted it to the court.” Through his Facebook, etc., he insists, “The current reporter is a party to suspicion without my permission, and it is a’conflict of powers’ who handed the whole recording file to the person who filed a lawsuit against me.

The clash between Candidate Park and lawyer Kim dates back to the time of the 2018 June 13 local election. At the time, lawyer Kim revealed that in September 2018, three months after the election of a Daejeon city councilor, “I was forced to finance illegal elections during local elections from Rep. Park Beom-gye.”

Attorney Kim insisted that “A former secretary to Park’s secretary and former Daejeon city councilman B, who is referred to as candidate Park’s aide, requested political funds worth 100 million won in exchange for nomination in April 2018.”

After Kim’s revelation, the Daejeon City Election Commission commissioned the prosecution to investigate the case in October 2018. As a result of the prosecution’s investigation, it was revealed that Mr. A and B requested 50 million won from Mr. C, as well as from Mr. Kim, as well as a preliminary candidate for a Western lawmaker in Daejeon at the time, and received 20 million won from Mr. C.

In November 2018, the prosecution indicted A and B for violating the Public Official Election Act. Afterwards, the two were sentenced to 1 year and 4 months in prison and 1 year and 6 months in prison, respectively.

Candidate Park officially apologized for the involvement of his aide in the allegations of illegal election funds revealed by lawyer Kim in November 2018. However, he denied any suspicions of his involvement, such as ‘aiding’.

In December 2018, the Democratic Party’s Daejeon City Party expelled from the party, saying, “Daejeon City Councilman Kim So-yeon declared false information to damage the party’s honor.” In the same month, Candidate Park filed a lawsuit for damages worth 100 million won, saying, “Attorney Kim spread false information and damaged his own reputation.”

Earlier, the controversy over’conflict of rights’ arose during the trial of this civil suit. The legal representative of Candidate Park submitted some of the recordings of the conversation to the court in early 2019, saying, “Attorney Kim met reporters in 2018 and spread false facts.” The recording, which lasts about 30 minutes, was recorded on November 15 and 16, 2018, when attorney Kim strongly criticized Congressman Park.

Attorney Kim insists, “At the time, candidate Park’s side obtained the entire recording.” It is the position that some of the transcripts were extracted and submitted as evidence of the lawsuit against Kim. In response, lawyer Kim sued the Daejeon District Prosecutor’s Office on charges of violating the Communications Secret Protection Act in April 2019, saying, “There is a possibility that candidate Park had secretly recorded it.” In July 2019, the prosecution dismissed candidate Park without prosecution, saying, “This case does not violate the Communications Secret Protection Act.”
