After the final decision of the US International Trade Commission (ITC), Georgia, where SK Innovation’s US factory is located, urged US President Joe Biden to exercise the veto. According to industry and foreign media on the 14th, Georgia Governor Brian Kemp asked President Biden on the 12th (local time) to overturn the final decision of the ITC. “Unfortunately, ITC’s recent decision puts SK’s 2,600 clean energy jobs at risk and significant investments in innovative manufacturing during the pandemic,” Governor Kemp said in a statement. He also warned that the long-term outlook for a $2.6 billion SK Innovation plant in Jackson County, Georgia, will be “a significant blow.” The plant will produce batteries for Volkswagen and Ford.

Despite Governor Kemp’s request, the White House has yet to make any move. The decision of ITC, an administrative agency, takes effect only after the final approval of the President. The President may veto for policy reasons after a 60-day review period. After the review period, the final trial decision is final.

Some point out that it will be difficult for President Biden, who has shown a strong position on China’s intellectual property infringement, to close his eyes to the infringement of trade secrets in his country. An industry official predicted, “This ITC decision admitted infringement of trade secrets, and it seems difficult for the Biden administration to exercise veto power as it has a temporary grace period as a protection measure for domestic companies such as Ford.”
