A taxi driver in his 60s who raped a drunk passenger in his 20s by taking a drunk passenger to a motel reiterated the argument at the appeal court. The 3rd Criminal Division of the Daejeon High Court said on the 5th that it had dismissed the appeal of Mr. A (68), who was accused of quasi-rape, and sentenced him to four years in prison.

Mr. A picked up Mr. B in Jung-gu, Daejeon around 11 pm on February 10 last year. At that time, Mr. B was drunk enough to lose his memory while drinking with his acquaintances. Mr. A took Mr. B to the motel and raped him. Mr. B was not aware of the damage until he woke up at the motel the next morning.

Mr. B left the motel and asked his acquaintances about the situation, and only after finding and asking the motel again, he suspected the victim of the sexual assault of the taxi driver Mr. A and reported it to the police.

During the trial with the investigative agency, Mr. A claimed that Mr. B did not get drunk or fell asleep at the time, and suggested having sex first. But his argument was not accepted.

Earlier, the first trial judge said, “It is difficult to believe that I proposed sex first because I was sexually lusted by alcohol to a person I have not seen for the first time at the age of 40 years or older.” Said.

Mr. A repeatedly appealed the claim that “Mr. B seduced him first,” but the court of appeals court ruled that “no matter how much consideration Mr. A argues, the sentence of the lower court cannot be deemed unfair.”
