The accident was unconditionally blamed on the driver?… Improvement of unfair contract with delivery agency platform

In the event of an accident in the delivery process, operators who operate delivery agency platforms such as People of Delivery, Yogiyo, and Coupang-it have decided not to unilaterally take responsibility for the delivery driver. In addition, when the contract is terminated for a delivery driver, it is decided to go through a procedure for prior notification and hearing opinions.

On the 20th, the Fair Trade Commission announced that three major delivery agency service companies, including elegant young people (Baemin Riders and Baemin Connector), Delivery Hero Korea (Yogiyo Express), and Coupang (Coupang Itz), had unfair potential in contracts with delivery drivers. It said that it was decided to self-correct the part.

The key to self-correction of contracts is’improving unfavorable liability for compensation’. In the existing contract, if there was a problem, the delivery driver was to indemnify the delivery agency.

In the future, the content that the driver indemnifies the operator in case of a problem will be deleted. If there is intention or negligence of the business operator, the business operator shall be responsible.

Previously, the contents of the contract, which was decided to terminate the contract based on the unilateral judgment of the business operator, have also been changed to go through a procedure to hear opinions after prior notification to the delivery driver. In addition, in the past, the basic delivery fee per delivery that was not included in the contract was specified in the contract.

The Fair Trade Commission estimated that more than 6,000 delivery drivers will be directly affected by the self-correction of companies this time. Baemin Connector and a part-time delivery engineer who works for a short time in Coupang-Itsu can also benefit. Delivery agency service providers plan to revise the contents of unfair contracts by the end of March.

An official from the FTC said, “The three delivery agency platform operators that participated in the autonomous correction of the contract plan to improve the contract by the first quarter of this year,” and said, “We will check whether the improvement will be made according to the autonomous correction scheme submitted by the operators.”

In addition, by checking whether there are unfair contract clauses in the contracts between delivery agency platform operators such as Logiol (as Saenggakdaero), Barogo (Barogo), and Mesh Korea (Vureung) and local delivery agencies, we induce the distribution of standard contracts I plan to do it.
