According to the “Status of Annual Tax Trial Claims and Handling Status” submitted by the National Assembly’s Planning and Finance Committee, Jeong Seong-ho, and the Democratic Party’s Office of Representatives from the Tax Tribunal and the National Tax Service, a total of 15,839 tax trial cases last year (January to November) were found. This is an increase of 35.3% from 11,703 cases in the previous year (January to December). Last year, the number of tax trial cases was the highest since the establishment of the Tax Tribunal in 2008.
Local tax cases such as acquisition tax were claimed from 1,490 cases in 2017, the first year of the Moon Jae-in administration, to 4,870 cases from January to November last year. Capital gains tax case claims increased from 982 to 1187 in the same period. As the number of requests for tax trials increased, the rate of handling claims by the tax judges, which was in the 70% range, fell to 50% last year.
Local taxes such as acquisition tax and transfer tax were cited at 43.9% and 20.5%, respectively, as of November last year. The government is losing 4 out of 10 cases in the case of local tax and 1 out of 5 cases in the case of transfer tax.
Rep. Seong-ho Jung said, “The reason why tax dissatisfaction has increased is not only due to the high tax burden, but also due to unclear taxation or differences in interpretation of laws and regulations. If this happens, tax complaints will also naturally decrease.”
