The so-called’naval sexual minority female sexual violence case’, which continued to inflict sexual violence against LGBTQ female subordinates, was also dealt with by the UN Human Rights Council.

The Joint Countermeasures Committee on Sexual Violence Cases of LGBTI Women by Naval Supervisors has received complaints from the UN Special Rapporteur on Violence against Women, the Working Committee on Women’s and Girls’ Rights, and the Special Rapporteur on LGBTQ through a special procedure established by the UN Human Rights Council resolution It was revealed on the 22nd.

This is a case in which the immediate supervisor of a female military officer who has just been appointed is suspicious of continuing to inflict sexual violence even though he knows that the victim is a sexual minority. In addition, when the victim informed of the victims of sexual violence and requested relief, the commander who was the captain at the time was also suspected of committing additional sexual violence.

In 2017, the Navy General Military Court sentenced the perpetrators to prison sentences of 10 and 8 years, respectively, but the following year the High Military Court of the Ministry of Defense found them innocent. Two years have passed since then, but the Supreme Court has not reached a conclusion.

The air commander said, “The supervisor who was in command and obedience sexually assaulted the victim about 10 times and raped twice, and additional sexual assaults occurred from the commander, and the basic rights of the victim were violated.” “The victim suffered from post-traumatic stress disorder (PTSD). I had to undergo hospital treatment for many years.

They said, “The High Military Court of the Ministry of National Defense violated the recommendation that the international human rights norms require sexual violence to be punished according to consent, and as the Supreme Court’s decision was delayed for more than two years, the right to receive damages remedies stipulated in the international human rights norms was violated.” Pointed out.

According to the Commission of the Air Force, during the two years in which the case was pending in the Supreme Court, the perpetrators live without any disciplinary action inside the military and receive a salary worth tens of millions of won each year, while the victims are only waiting for the Supreme Court sentence without returning to the ship’s work.

The Commission requested that UN human rights experts recommend the Supreme Court’s prompt appeal. In addition, he asked the Navy to “start disciplinary proceedings as soon as possible for the perpetrators who live their daily lives as if they were completely innocent, hiding behind the rule that their offenses were not violent enough to constitute the charged offence.”
