SK and LG, “distorted” each other over battery trial for invalidation of US patents… intensifying conflict

SK Innovation argued that “LG Energy Solutions is misleading public opinion,” saying it was a procedural issue about the decision of the US Patent Tribunal (PTAB) to dismiss the battery patent lawsuit with LG Energy Solutions. Accordingly, LG Energy Solutions responded by saying, “It is clear that SK Innovation has lost its opportunity as all PTAB applications were rejected.”

SK Innovation said on the 15th that the press release was “dismissed for procedural reasons” to PTAB’s decision. SK Innovation said, “In relation to this patent-free song, LG Energy Solutions is misleading, distorting it as a substantive legal decision that some of the complicated US litigation procedures have not been carried out according to the policy changes of the US Patent Office.”

The previous day, LG Energy Solutions reported that all eight trials of PTAB’s patent invalidation were dismissed at the end of last year and recently, which is a refutation. LG Energy Solutions said, “SK Innovation has not even started a fight, and it seems that there will be a blow to the patent litigation strategy.”

SK Innovation emphasized, “While PTAB rejects the request to initiate a patent invalidation trial investigation for procedural reasons, it is mentioning the possibility of invalidation of the LG Energy Solution patent on an essential issue.” In this regard, SK Innovation said that the ruling is separate from the patent litigation in progress by the US International Trade Commission (ITC), and that the procedure for arguing that the patent of LG Energy Solutions is invalid in the ongoing ITC procedure is proceeding as scheduled.

Both companies are filing a lawsuit for infringement of trade secrets and patent litigation at the US ITC. The patent invalidation trial by the Patent Tribunal came out of the patent litigation process. On the 12th (local time), PTAB decided to reject the initiation of investigations on two patent invalidation trials (IPRs) filed by SK Innovation against LG Energy Solutions. Accordingly, PTAB rejected a total of 8 referee claims filed by SK Innovation, up to 6 cases dismissed in November last year.
