The Ministry of Industry explained that the purpose of the extension of the period is not to resume the business, but to prevent the disadvantages of KHNP, which will occur when the business license is cancelled, and to maintain the business license for a limited time until a system for smooth business termination is established.

After acquiring the permit for the power generation project of Shinhanul Units 3 and 4 (February 27, 2017), the energy conversion policy made it difficult to obtain approval for the construction plan within the statutory deadline (February 27, 2021). I applied for it on January 8.

KHNP raised the reason for the extension of the construction plan approval period as the reason that it was not possible to obtain the approval for the construction plan within the due date in a situation where it is difficult to obtain the approval for the construction plan within the due date due to the suspension of the procedures for reviewing and approving permits such as construction permits in accordance with the government’s energy conversion policy. .

If KHNP’s power generation business license is cancelled, it is difficult to obtain a new power generation business license for the next two years, so it is difficult to secure the ninth basic power supply and demand plan in a timely manner.Therefore, separate administrative measures related to the power generation business license, enactment of laws, and cost preservation This is why it is necessary to maintain the power generation project permit until the relevant laws and regulations are established.

Under the Electricity Business Act (Article 12), if a power generation business operator does not obtain permission for a construction plan within the period notified by the Minister of Industry (Shin Hanul Units 3 and 4: 4 years) after obtaining a power generation business license, the Minister of Industry shall obtain a business license. It is stipulated to cancel.

As KHNP’s energy conversion policy was not attributable to the Ministry of Industry, it was difficult to revoke the business license under the Electricity Business Act (Article 12) because KHNP did not receive approval for the construction plan of Shinhanul Units 3 and 4 within the deadline. It said that it was judged appropriate to extend the construction plan approval period.

On the other hand, the Ministry of Industry and Industry considers the principle of preserving the expenses that the government has expended in the energy conversion roadmap (October 2017) for the extension period of approval for the construction plan. It is explained that the decision was made until December 2023 when KHNP applied for the period necessary for termination.

It is explained that the Ministry of Industry announced the legislative amendment to the Electricity Business Act Enforcement Decree in September 2020 in relation to the conservation of costs due to energy conversion, such as the termination of the business, and plans to implement it after the revision as soon as the examination and consultation with the Ministry of Legislation are completed.
