[에너지데일리 송병훈 기자] The Ministry of Trade, Industry and Energy announced on the 22nd that the approval period for the construction plan of Shinhanul Nuclear Power Plant Units 3 and 4 was extended until December 2023, when Korea Hydro & Nuclear Power applied for it.

The Ministry of Industry explained that the purpose of the extension of the period is not to resume the business, but to prevent the disadvantages of KHNP, which will occur when the business license is cancelled, and to maintain the business license for a limited time until a system for smooth business termination is established.

After acquiring the permit for the power generation business of Shinhanul Units 3 and 4 (February 27, 2017), the energy conversion policy made it difficult to obtain approval for the construction plan within the statutory deadline (February 27, 2021). Applied for an extension of the construction plan approval period.

KHNP’s construction plan approval period was extended due to the government’s energy conversion policy. If the power generation business license is cancelled, it is difficult to obtain a new power generation business license for the next two years, and therefore it is difficult to secure timely capacity for the ninth basic power supply and demand plan. It said that it is necessary to maintain permission for power generation projects until the relevant laws are established.

According to Article 12 of the Current Electricity Business Act, if a commercial power generation business operator fails to obtain a construction plan approval within the period notified by the Minister of Industry (Shin Hanul Units 3 and 4: 4 years) without justifiable reason after acquiring a power generation business license, the Minister of Commerce It is prescribed to cancel.

The Ministry of Industry, KHNP, has not received approval for the construction plan of Shinhanul Units 3 and 4 within the deadline due to the energy conversion policy without any cause attributable to it. He explained that it was judged appropriate to extend the construction plan approval period.

In addition, regarding the extension period of approval for construction plans, the government considers the principle of preservation of expenses expenditures legally and fairly stated in the Energy Conversion Roadmap (October 2017), and to prevent disadvantages of business operators and smooth business termination rather than resumption of business. Considering the necessary period, KHNP announced that it was decided by December 2023 when it applied.

On the other hand, the Ministry of Industry and Industry announced a legislative amendment to the Electricity Business Act Enforcement Decree in September 2020 in relation to the conservation of costs resulting from energy conversion such as business termination, and will be implemented after the revision as soon as the examination and consultation with the Ministry of Legislation are completed.
