Sergeant Byun returned to Korea after undergoing sex change surgery while on vacation in November 2019 while working for the army’s parent unit, hoping to “continue to serve”. However, the Army decided to discharge Sergeant Byun on the third degree of mental and physical disability and on January 22 last year.
Sergeant Byun dissatisfied with this and filed a personnel appeal, but when it was dismissed in June of last year, he filed an administrative lawsuit to cancel the disposition under the Daejeon District Law on August 11th. A pleading date was scheduled for April, but Sergeant Byeon was found dead at his home in Cheongju on the 3rd.
