[아이뉴스24 서민지 기자] The Samsung Compliance Committee (Compliance Committee) determined that the requirements and scope of Samsung Electronics Vice Chairman Lee Jae-yong’s’employment restrictions’ were unclear. In this regard, the Compliance Committee is planning to recommend Samsung Electronics not to cause any illegal activities.

The Compliance Committee said, “There are uncertainties about the requirements and scope of employment restrictions.”

Earlier, the Ministry of Justice informed Vice Chairman Lee last month that he was subject to employment restrictions. This is because he was sentenced to jail for the case of’Gukjeong Nongdan’.

According to the Specific Economic Crimes Weighted Penalty Act (Special Police Act), if a person is convicted of embezzlement or malpractice of 500 million won or more, they cannot get a job at a company related to the crime. The employment restriction period is 5 years from the date when the execution of the imprisonment sentence ends or the execution is confirmed to be stopped. However, if Vice-Chairman Lee’s side applies for employment approval, the Ministry of Justice may deliberate on the possibility of employment.

There is an element of debate over the application of the law. There is an ambiguous aspect of applying the law to the state where the sentence is currently being executed, as the provisions of the law stipulate that the subject of employment restrictions is’when the execution of the sentence is terminated’.

Some people say that vice-chairman Lee already resigned from the registered executive last year and is running unpaid management, so it cannot be considered as employment, so it is not related to the restrictions on employment.

The Compliance Committee also looked into the suspicion of illegal support for the labor-management council. The delegation of the Samsung Group’s labor union filed a complaint with the Ministry of Labor last month, saying, “Samsung Group is suppressing and neutralizing the union by illegally supporting and operating the labor-management council.”

In this regard, the Compliance Committee received reports on internal transaction agendas of affiliates, received reports and reports, and discussed ways to deal with them. It was also requested to receive reports on the facts and improvement measures from the compliance officer of the affiliated company, and to continuously manage the activities of the labor-management council so that it does not violate the law.

Prior to the meeting, the Compliance Committee held a meeting with the heads of the project support TF, the financial competitiveness improvement TF, and the EPC competitiveness strengthening TF for the first time since its inception. It was prepared for two hours to prepare countermeasures for future compliance risks and to communicate with each other.

Samsung Electronics President Jung Hyun-ho, Samsung Electronics Vice President Jeong Hae-rin, Samsung C&T President Kim Myung-soo, and Samsung Life Insurance Vice President Park Jong-moon attended the event. The committee emphasized securing transparency and preventing conflicts of interest related to TF activities, and participants agreed on the importance of preventing the risk of violation of compliance obligations in TF activities.

Meanwhile, seven affiliates, including Samsung Electronics, Samsung Electro-Mechanics, Samsung SDI, Samsung SDS, Samsung C&T, Samsung Life Insurance, and Samsung Fire & Marine, held a board of directors this month and appointed Professor Won Sook-yeon of Ewha Womans University Administration Department recommended by Chairman Kim Ji-hyung as a new member. The new member of Won is an expert with rich knowledge and experience in the field of administration and regulation, and has served as a member of the Regulatory Reform Committee directly under the President, as well as an evaluation and advisory committee at the Supreme Prosecutors’ Office, Ministry of Materials, Ministry of Justice, and Personnel Innovation Office.
