At the time of the 21st general election, the prosecution sought a fine from the incumbent Seoul City councilor who was handed over to trial for posting false facts in the election publication of the Democratic Party lawmaker Gom Jeong-jung.

On the 10th, the prosecution asked the court to sentence a fine of 1.5 million won at the decision hearing of Seoul Metropolitan Councilman Kim Mo, 44, held at the hearing of the 11th Division of the Seoul Eastern District Law Criminal Agreement (Director Kyung-ah Yoon).

On this day, the prosecution said, “Kim is a person presiding in relation to public affairs affairs, and he knew that (remarks supported by the Residents’ Self-government Committee) would become public articles,” he argued.

Kim’s side denied the charges as in the previous trial. In his final statement, Mr. Kim said, “I thought that consent to publication of the publication should of course be received by the candidate or the president of the election camp, and I received and delivered the photo to be used for the publication from Mr. A (resident self-government committee and local merchant chairperson). “It’s very painful mentally to overwrite the phrase that I got it.”

Mr. Kim continued, “I fully explained to Mr. A that it was a photograph to be used in the publication, and Mr. A recognized this and sent him a picture.” “But I was belatedly aware that I could not intervene in the election as a resident self-government committee and my attitude changed.” Added.

Kim, who worked as the head of the election campaign in the late March-April last year, was charged with posting pictures and remarks of Mr. A, a resident self-government committee member and regional merchant chairman, in an election bulletin without consent (violation of the Public Official Election Act).

The publication included the content that Mr. A said, “With only 10 members of the National Assembly like Ko Min-jung, it will become a savory Republic of Korea.” However, Mr. A insisted that he had never expressed support for Congressman Ko or allowed the remarks to be published in a publication.

The Gwangjin-gu Election Commission requested that the high lawmaker and Mr. Kim be investigated by the prosecution in early April of last year, citing that resident self-government members are not allowed to campaign under the current law. The prosecution indicted the late lawmaker without prosecution and only prosecuted Kim, the person in charge of public affairs.

At the time of the 4th trial, the late lawmaker, who was present as a witness, said that he did not know that Kim had put the residents’ self-government committee in the public notice, and that he learned that a photo of the resident self-governing committee was uploaded in the publication.

Kim’s side argued that there was no real authority in the camp at the time, and it was not intentional because the production of publications was not led by himself.

Kim’s sentence will be held on the 2nd of next month.
