In order to save labor costs, a large number of private expressways were found, where workers were injured by expedient methods such as establishing a camouflage service company.

The Ministry of Employment and Labor announced on the 2nd that it had detected 399 people illegally dispatched on seven of 45 private highways nationwide (including private roads). Since May of last year, the Ministry of Employment has supervised labor in relation to illegal dispatch of private expressway operators. There are 4,220 workers working for these enterprises or service companies.

Among the workers who were judged to be dispatched illegally, the number of payers was 316, followed by traffic patrol and control (41), road maintenance (30), and transportation system (ITS) maintenance (12).

These companies did not hesitate to establish a ghost company to reduce labor costs. The manager of Mo Daekyo established a service company while operating the bridge. The management company paid the full amount of the investment. The CEO also has the same operator and service provider. After creating a service worker like this, 42 workers were hired to drive all of the work. There were no service contracts with other contractors. An official from the Ministry of Employment said, “It is difficult for the service provider to recognize its identity as a business owner.” In fact, it is a company with only a separate name, and in reality, it is a paper company.

Accordingly, the Ministry of Employment determined that all 42 workers had an implied labor contract relationship with the manager. The contract between the operator and the service provider is a camouflage contract, meaning that the service staff are not affiliated with the service company but are directly employed by the management company.

On the private expressway, the service company workers used the work manuals produced by corporations or operators. This also means that it is impossible to distinguish between subcontractors and subcontractors because the work of the contractor and the contractor is the same. In particular, through group katok rooms and meetings, direct instructions to service workers or payments and reports were received from time to time. The Ministry of Employment and Employment decided that “the company is divided into a single organization system, or the subcontractor’s workers are actually incorporated and operated.”
