Polish government Safeng 2077 investigation, possible fines

Will Polish Competition and Consumer Protection Agency (Urząd Ochrony Konkurencji i Konsumentów, UOKiK) take direct action on user complaints from Cyberpunk 2077? UOKiK directly checks the progress of game revisions and response to user complaints from CD Project Red (CDPR), the developer.

On the 9th, a number of Polish media such as Gennik Gazzetta Pravna and Benchmark reported that they were interested in the initial issue of’Cyberpunk 2077′, citing UOKiK’s statement. UOKiK spokeswoman Małgorzata Cieloch said, “We ask the company to explain the problem of the game and the actions taken (to solve it).” “We will see how we will behave in relation to those who are there.”

The key is publisher assurance that the game works. Before the release of’Cyberpunk 2077′, CDPR said that the game worked without problems on the current generation console, but it showed poor optimization and performance that was impossible to play. Since console devices have a set configuration unlike PCs, it is difficult to refute that if they meet upgrades or peripheral devices, they can enjoy the game smoothly.

Poland’s countermeasures against unfair market practices are that market conventions used by entrepreneurs targeting consumers are contrary to morality or distort or distort the market behavior of ordinary consumers (such as purchasing decisions) before or after signing a product contract. It is stated in Article 4(1) that it is unfair if possible.

Dominique Yepzeiko, an attorney at the Polish local law firm Kashviak Yepzeiko, points out that the CDPR’s assurance of good gameplay on previous generation consoles through his online channel distorted market behavior. He said it doesn’t matter if this is a deliberate act or a result of carelessness, and there is room for class action that could be a legal issue.

Attorney Dominique said that the issues that are currently being pointed out may be just the beginning. He also noted the possibility that UOKiK could face CDPR with fines imposed on entrepreneurs for judging consumer interest infringement.

UOKiK may impose fines on companies for misleading omissions in Article 6 of the Countermeasures against Unfair Market Practices. The fine cannot exceed the maximum 10% of sales based on average monthly sales and 12-month fiscal year. However, the imposition of a fine is a court possibility on the premise of the worst situation, and UOKiK did not specifically mention this.

‘Cyberpunk 2077’, which was released to the public with the title release in 2012, received the attention of fans as a long-anticipated CDPR work. In addition, the CD project was selected as a candidate for each sector in GameINN, a development support program organized by the Polish National Research and Development Center. According to the four applications of CDPR and GOG.com, about 30 million Polish Zloty (approximately 8.88 billion KRW) was supported.

However, the game is released at a level that makes it almost impossible to play the current generation console version, such as graphics, animation, and bugs in missions, and fans’ criticism could not be avoided. As a result, Sony removed the game from the PlayStation Store and Microsoft added a return option, and the current generation of console developers indicated that there was a problem with the current generation of console play of’Cyberpunk 2077′. Accordingly, the developer posted an apology and said that it would improve the problem through an update patch.
