The trial for suspension of execution is based on whether the applicant has incurred irreparable damage and the need for urgent measures to prevent this. In the main lawsuit, the reasons for disciplinary action and procedural justification are judged in earnest. In the end, the purpose is to consider the suitability and procedural justification of the disciplinary content of the Prosecutor and Discipline Committee of the Ministry of Justice.

Attorney Ok-hyung Lee on the Minister’s side said, “Many questions such as procedural and substantive defects in the disciplinary action, authority and subject of judgment, etc. have come and gone from the court.” General Yoon’s lawyer Son Kyung-sik said, “Most of the data that had been denied access or registration (by the Ministry of Justice) have been submitted to the court.” An attorney from a judge explained, “There is a high possibility that the suspension period will pass during the main case trial, so the suspension of execution trial is an important self-conclusive case.” In particular, the court asked the two sides to answer seven questions on this day.
