The Supreme Court’s final decision is made on the 14th against former President Park Geun-hye, who has been tried in the case of repayment of special activity expenses by the National Intelligence Service and the National Intelligence Service.

It has been four years and two months since the case of the Gukjeong Nongdan incident occurred in October 2016 with the release of Choi Soon-sil’s tablet PC.

The third division of the Supreme Court (Presiding Judge Roh Tae-ak) will conduct a trial for reconsideration of former President Park, who was charged with bribery under the Aggravated Punishment Act for certain crimes at 11 am.

Former President Park was sentenced to 15 years in prison for bribery, 18 billion won in fines, and 5 years in prison for the rest of the charges, including loss of the government, at a repatriation trial last July.

This is significantly less than the 30-year prison sentence and 20 billion won in fines, which were sentenced to an appeals trial before remand for destruction. This is because the charges of coercion and obstruction of the exercise of some ex officio abuse rights were turned over to innocence according to the purpose of the Supreme Court’s ruling for destruction and return.

The prosecution objected to the ruling on the remand of revocation and appealed again, but former President Park did not appeal.

As the case of former President Park has already been judged by the Supreme Court for appeal, and the ruling for reversal of retrieval proceeded according to the purpose of the appeal, it is the public opinion of the legal community that the judgment of re-revocation deliberation will be maintained in the re-appeal.

If the Supreme Court confirms the sentence according to the ruling of the revocation and repatriation trial, former President Park will have to end his sentence of 22 years in total, including the two years already confirmed for intervening in the Saenuri Party nomination.

It is also of interest that discussions on special pardons with former President Lee Myung-bak will resume once the sentence of former President Park is confirmed.

However, the opinion that the amnesty theory should be approached carefully is not easy, given that both former President Park and former President Lee were convicted of the bribery that President Moon Jae-in referred to as the object of exclusion.
