On the 14th, former President Park Geun-hye (69), who was handed over to the trial in the case of the Gukjeong Nongdan case and the repayment of special activity expenses (special activity expenses) by the National Intelligence Service, is finally judged by the Supreme Court. As it has already been judged by the Supreme Court’s appeal, there is a high possibility that the sentence will be finalized as previously declared. After the three-year and nine-month trial is over, special pardon requirements for former President Park will be in place.

The third division of the Supreme Court (Presidential Judge Roh Tae-ak) will hold a hearing for the reconsideration of former President Park at 11:15 am on the 14th. In July last year, former President Park was sentenced to 20 years in prison at a repatriation trial. At that time, the court judged by combining the case of the Gukjeong Nongdan case and the case of reimbursement of special expenses, imprisoned 15 years and fined 18 billion won for the charges of receiving bribes while in office, and 5 years imprisonment for all other charges and imposed an additional 3.5 billion won. .
Cases related to former President Park are largely divided into two categories: the case of Gukjeong Nongdan and the case of reimbursement of special expenses. The two cases, which were originally tried separately, were merged after being destroyed and repatriated by the Supreme Court in August and November 2019, respectively.
Possibility to maintain the sentence
When the Supreme Court destroyed and repatriated the two cases, it decided on the key issues. The ruling and repatriation trial was declared in accordance with the judgment of the Supreme Court. This is why we believe that the re-appeal court is highly likely to maintain the sentence of reconsideration and repatriation. Former President Park did not reappeal after the revocation review. The prosecution reapplied the judgment of some innocence in the blacklist case of the Ministry of Culture, Sports and Tourism during the remand deliberation. As such, the Supreme Court is expected to close the case by reviewing only the reasons for reappealing the prosecutor’s office on the part of the acquittal.

Former President Park was arrested in March 2017 due to suspicion of Gukjeong Nongdan, and was handed over to trial in April of that year when the tablet PC of Choi Seo-won (formerly Choi Soon-sil) was known to the world. In connection with the Mir-K Sports Foundation, they are alleged to make contributions to the National Federation of Businessmen and large corporations, or to request bribes from Lotte, Samsung, and SK Group. The Seoul Central District Court, who served as the first trial, sentenced former President Park to 24 years in prison and a fine of 18 billion won. At the appeal trial, he was sentenced to 25 years in prison and a fine of 20 billion won as the accrued amount of bribes related to Samsung increased. In August 2019, the Supreme Court ruled that the sentence of former President Park’s first and second trial was unlawful because it did not separate the charges for bribery and remanded it for destruction.
The case of reimbursement of special expenses for the NIS is alleged that the former President Park received monthly special expenses for the NIS from May 2013 to July 2016 from May 2013 to July 2016 from former NIS chiefs Nam Jae-jun, Lee Byeong-ki, and Lee Byeong-ho in cash.
Former director Nam gave 600 million won each for 50 million won 12 times, former director Lee Byeong-ki gave 800 million won each for 8 times, and former director Lee Byeong-ho gave 1.9 billion won each. A total of 3.3 billion won was delivered to the former President Park. will be. Separately, former director Lee Byung-ho was also charged with an additional 200 million won in September 2016.
The prosecution applied charges of loss of government treasury and bribery on the case that the chiefs of the National Intelligence Service paid special expenses to former President Park. The first trial was not a bribe because it was not possible to recognize the price, but he admitted that the president had inflicted losses on the national treasury by conspiring with the head of the National Intelligence Service. The first trial admitted to former President Park a six-year imprisonment and an additional premium of 3.3 billion won. The second trial sentenced him to five years in prison and an additional premium of 2.7 billion won, saying that the money received from the former chief of the National Intelligence Service (NIS) should be judged as embezzlement, not as a loss from the state treasury. In November 2019, the Supreme Court abolished the second trial and admitted that all 3.3 billion won was a crime for loss of the national treasury, and decided to admit 200 million won received from former director Lee Byung-ho as bribes.

22 years in prison must be ended if it is confirmed as the destructive and repatriation trial.
If the sentence is confirmed, the trial against former President Park in relation to Gukjeong Nongdan will be concluded after three years and nine months after it was handed over to trial in April 2017. If the Supreme Court confirms the sentence according to the ruling of the revocation and repatriation trial, former President Park will have to end his sentence of 22 years in total, including the two years already confirmed for intervening in the Saenuri Party nomination.
It also meets the requirements of’a person sentenced to a sentence’, which is the subject of a special pardon prescribed in the Amnesty Act. As a result, there are observations that the discussion of special pardons for the former president in the political world could reignite. Former President Lee Myung-bak already had special pardon requirements. Former President Park, who was arrested in March 2017, has already finished executing the two-year imprisonment that was previously confirmed out of a total of 22 years. If there is no pardon or parole, the sentence will be ended in 2039. This is when the former President Park turns 87.
