The High-ranking Public Officials Crime Investigation Office (Public Investigation Department) received a public interest report from the National Rights Commission regarding the allegations of illegal departure from the former Vice Minister of Justice Kim Hak-eui.

On the morning of the 5th, the Ministry of Public Service took over from the KFTC a record of public interest reporting that major positions and public officials in the Ministry of Justice violated the Immigration Control Act and the Personal Information Protection Act and abused their authority in connection with the ban on departure from the former Vice Minister Kim.

Earlier, on the 30th of last month, the Kwonik Committee announced that it had decided to request an investigation to the public authorities, saying, “We determined that there is a need for an investigation,” as a result of checking the contents of the report of the public interest reporter.

Accordingly, the Ministry of Public Service said, “I will determine (how to deal with this) after confirming the report and review details,” and the record could be reviewed six days after the announcement of the investigation request by the KFTC.

However, it seems difficult to review the records right away by entering the interview with the investigator from this day to the 13th, with Deputy Chief Kim Jin-wook and Deputy Chief Yeo Un-guk, who have the right to make decisions.

The Ministry of Public Affairs and Communications plans to determine how similar the contents of the report to the KFTC are to the’Kim Hak’s case’ being investigated by Suwon District Prosecutors’ Office, and then decide whether to investigate directly or transfer to the prosecution.

Last month, the Ministry of Public Affairs took over the contents of Seoul Central District Prosecutors’ Office, Lee Seong-yoon and Prosecutor Lee Gyu-won, the key suspects in Kim Hak’s case from the Suwon District Prosecutor’s Office last month, and relocated to the Suwon District Prosecutor’s Office because of the lack of investigative personnel.

Since then, Suwon District Prosecutors’ Office rejected a request from the airlift to “send it after the investigation,” and handed prosecutor Lee Gyu-won to trial on the 1st, in a state of disability. Accordingly, the airborne ministry did not come up with a different position.

According to the Enforcement Decree of the Anti-Corruption Rights Violation Act, in principle, an investigating agency cannot transfer a case handed over from the rights commission to another investigating agency. However, if it is deemed inappropriate to be dealt with by the relevant investigating agency, the transfer may be made through consultation with the Authority.
