Kwak Sang-do, a member of the National Assembly’s Board of Education, released the results of a review of the law regarding the cancellation of admission by the Ministry of Education on the 23rd. Earlier, Rep. Kwak requested the Ministry of Education to “conduct legal review (related to cancellation of admission)” at the general meeting of the Education Committee on the 16th.
According to the reply released by Kwak, the Ministry of Education said, “This is an unusual case in which the investigation before the Ministry of Education’s audit was initiated and the trial was conducted, and could become an important criterion if a similar situation arises in the future.”
Next, as to whether admission can be canceled before the court’s final judgment is issued, he said, “It is possible for the university to investigate the facts related to the suspicion related to the on-campus entrance examination and take a series of measures separately from the criminal trial.” It is the same as the remarks of Yu Eun-hye, Vice Prime Minister of Social Affairs and Minister of Education, that “the cancellation of admission is the authority of the principal.
However, he thought that according to the revised Higher Education Act, the admission of Mr. Cho cannot be canceled immediately. According to the Higher Education Act revised last year, if false data are submitted for admission, universities must cancel the admission (Article 34-6 of the Higher Education Act). The Ministry of Education believes that applying the provisions in force since June 10 last year to the case of Mr. Cho who entered the 2015 school year would be applied retrospectively. The Ministry of Education concluded that “it is retroactive, so it is not applicable (for Mr. Cho’s case),” and concluded that “cancellation is possible according to Pusan National University’s school regulations and application guidelines.
Last year, the court admitted the fact that Jo’s mother, Professor Kyung-Shim Chung, submitted forged documents in order to pass her daughter’s medical service in the first trial.
