A middle school female teacher, who denied the crime, was sentenced to sexual abuse against emotionally unstable school violence victims, claiming that “the relationship was consensual” or “rather sexually assaulted”.
The 13th Criminal Division of the Incheon District Law (Presidential Court Eun-seol Ko) sentenced A (39, female) to a former middle school teacher accused of violating the Special Cases Act on the punishment of child abuse crimes, etc. It was revealed on the 16th.
In addition, they ordered the completion of the 40-hour child abuse treatment program and the child adolescents and child-related institutions to restrict employment for 7 years each.
Mr. A was charged with sexually abusing District B (at the time 15 years old, 3rd grader) in a total of 7 times in the campus and residence of a middle school in Yeonsu-gu, Incheon from September 2018 to January 2019.
It was investigated that Mr. A, an art teacher, was sexually assaulted by calling Army B into the art room and sexually assaulting them while serving as the homeroom teacher of Group B.
It was found that Mr. A committed the crime after receiving a request from parents to take good care of Group B, who was emotionally unstable due to trauma and experience of being damaged by school violence in the first year of middle school.
Mr. A called Army B to the art room, sexually abused him, and raped him in a car for bringing Army B to his house, and it was found that he took Army B to his house and committed sexual assault.
Mr. A was confirmed to have committed violence if Army B refused.
Mr. A was sued by the parents of Army B, was investigated and handed over to trial. A, who was a fixed-term teacher, left school after the contract expired.
Mr. A denied the crime, claiming that he was innocent because he was in an agreement with Army B at the trial and did not receive the money requested by Army B.
However, the court did not accept the claim in the light of legally adopted evidence.
The judge said, “The defendant, who is a middle school teacher, committed sexual abuse to the victim child while having repeated sex with the victim child who is a student in the same class for several months.” He was well aware that he was in an unstable state, and despite having a husband and children, he actively expressed favor with the victim and asked for sexual behavior, but if he refused, he was assaulted.”
“As a homeroom teacher, despite being in the position of the second most important guardian after the parents of the victim, he continued sexual behavior using the superior position.” “The victim was unable to shake his body or write letters due to the continued abnormal relationship with the defendant. I was suffering from extreme anxiety, such as shaking my hand, and I was diagnosed with an undifferentiated somatoform disorder at the hospital and received medication. I have been suffering from nightmares and insomnia for a long time, and I am having difficulties in my daily life.”
The judge said, “Even so, the defendant denies the crime, sues the victim for sexual violence, etc., and does not show any remorse for the mistake, such as continuously collecting and submitting information on the victim’s private life.” “I did not make any effort to recover the damage or the damage, and the victims and their families are petitioning for severe punishment, but I quit school after this incident and decided on the sentence in consideration of the fact that I am not working as a teacher.”
