Marine City Jai in Haeundae-gu, Busan, which has a conflict with the residents over the cancellation of the apartment supply contract (Busan Ilbo, January 8, 12 p.m., etc.). Regarding this, the Haeundae-gu office having jurisdiction said, “Relieving victims in good faith comes first,” and “I will not approve the resale.”

On the 18th, Company A, in charge of implementing Marine City Xi, announced on the 18th that it would re-sold 41 households, which were confirmed to be illegally subscribed, at a’market price close to the original sale price’. Company A said in a statement on the day that it was appropriate to give opportunities to the actual victims and many homeless people who had to win through resale. This is interpreted to show that some criticisms that the developer is trying to cancel the supply contract in an effort to increase the house price is different from the fact.

Enforcer “Relief system for victims in good faith It must be done through laws and institutions”

Residents “Even knowing about illegal subscription The operator does nothing”

Ward Office “Protection of victims is the top priorityAdmission is unchanged when there is no remedy.”

Company A’s position is that because the market order was disturbed by illegal subscriptions, the supply contract should be canceled as specified in the law, and the relief of the victims in good faith should be done through laws and systems, not through the maintenance of the illegal contract. Company A said, “If the 41st generation in question paid a premium according to the market price to the element owner, the premium could be returned through a lawsuit against the element owner.”

Residents who were confronting with the developer rebelled against the sudden announcement of the administrator’s position on the day as “a belated response without measures to relieve the victims of good faith”. These residents said, “Nowhere in the entrance statement, we did not mention the fact that the business operator did not take any action in the meantime even though he knew about the illegal subscription that has been revealed in some households from the past.” I proved that I was a victim, but the enforcer only made excuses. They argued that if the original winner, who was illegally supplied with an apartment due to manipulation of documents, was left behind and only the apartment was taken from the final buyer, such illegal activity would be more rampant in the future.

Haeundae-gu Office also expressed its intention to maintain the existing policy not to approve the resale of the household. Haeundae-gu mayor Hong Sun-heon said in this report on the 18th, “Protecting victims of good faith from becoming real victims is our top priority.” He added that “there will be no change of position without measures to relieve the victims of good faith.” He added, “If we respond legally, the ward office will also respond thoroughly.”

Earlier, in the Marine City Xi apartment, a total of 41 households were exposed to illegal subscriptions, leading to controversy. The implementer said it would cancel the housing supply contract, and confronted that the residents who bought apartments without knowing the illegal subscription had no choice but to become victims of good faith. Criticism has also been raised that the apartment price has risen a lot and that the developer is trying to earn profits by raising the resale price.

Regarding this situation, Congressman Ha Tae-gyeong (Haeun Dae-gap) of the People’s Strength, representatively proposed the’Amendment of the Housing Act’. The new amendment included a new clause stating that if the buyer of the house clarifies that it is not related to the disturbance of the supply order, the housing supply contract should not be canceled. However, even if the housing law amendment is passed, it seems unlikely that the amendment will be retroactive to Marine City Xi residents. The implementer pushes for cancellation of the supply contract, but the competent ward office said it would not approve it, and there is no small possibility that it would turn into a legal dispute.
