The judge said, “The defendant (Vice-Chairman Lee) actively offered bribes by taking advantage of former President Park Geun-hye’s request for bribery, and made an implicit request to use the president’s authority for succession work.”

In particular, he explained, “It is difficult to say that it has met the effectiveness criteria,” and said, “It is possible to evaluate the authenticity of the defendant and Samsung positively, but in this case, it is not appropriate to take into account the terms of the sentence.” did.

However, the judge explained the background of the sentencing, saying, “It is somewhat unfair to apply the sentencing standard as it is, even if a sentence is imprisoned, considering that it is very difficult to refuse a bribe if the president requests a bribe in reality.”

Immediately after the sentence, Vice Chairman Lee’s defense counsel said, “The nature of this case was the ex officio abuse of the former President, and the company was infringed upon freedom and property rights,” and said, “Considering that, the judgment of the judge is regrettable.”

The appeals court judged a significant portion of the amount that was convicted in the first trial as innocent and admitted it as a bribe of 3.6 billion won. The sentence was also drastically lowered, and Lee was released after being sentenced to two years and six months in prison and four years probation.

Afterwards, the Supreme Court’s all-in-one consensus broke the judgment and returned the case to the Seoul High Court, saying that about 5 billion won was found guilty at the appeal trial.
