Prosecutors argued that Professor Jeong forged a citation in the name of the president of Tong Yang University and was issued falsely, and that this was returned as a benefit for her daughter’s entrance exam. The court admitted that Professor Jeong was guilty of gaining profits (violation of the Capital Markets Act) by obtaining undisclosed information about a secondary battery company invested by Korink PE, a private equity fund manager. Along with this, the charge of opening a borrowed account to conceal the details of the property (violation of the Real Name Financial Law) was also considered guilty.

Deputy Judge Lim said, “Professor Jeong used a nominated account with the intention of concealing stocks and escaping the submission obligation when Cho was inaugurated as the Chief Civil Service Officer of the Blue House. Accordingly, despite the legal obligation to faithfully report property, he criticized strongly that he borrowed other people’s accounts to increase his assets, used undisclosed information, and concealed criminal proceeds.”

On the other hand, it was considered innocent that Professor Jeong signed a false consulting contract and received money from Cho’s 5th nephew, Beom-dong, who participated in embezzlement. Prof. Chung’s alleged conspiracy with Jo Beom-dong to falsely report the amount of the investment agreement to the Financial Services Commission, and the charge of having Kim Gyeong-rok, an asset manager, to conceal materials from the Tong Yang University office were also acknowledged as innocent.

Controversy over unreasonable prosecution and investigation results are guilty

Regarding the alleged corruption of Cho’s daughter’s entrance examination, the prosecution confiscated and searched more than 30 places, including all of the Busan National University medical doctors, resulting in controversy over investigations. In particular, in September of last year, there was an irrational prosecution of Professor Jeong without even summoning him for the imminent statute of limitations on charges of forgery of the Tong Yang University citation. At that time, the legal and political circles confronted the interpretation that “it was an inevitable decision for the prosecution” and the public opinion that it was “excessive investigation difficult to find precedent”.

However, after one year and three months after the prosecution indicted Professor Chung in September last year, all charges of irregularities in the entrance examination were convicted, and the criticism that it was an unreasonable prosecution lost convincing power.

Prof. Jeong said that it was “a ruling that applied guilty crime,” and expressed his intention to actively refute it at the appeal trial.
