‘Jeong Bong-ju is not guilty of the second trial’, “when in doubt, in the interest of the defendant”

Chung Bong-ju, a former United Democratic Party lawmaker, 60, who was convicted of defaming Pressian, a fraudulent and false accusation (innocent), was acquitted at the second trial.

In December 2011, when a reporter reporter (Mr. A) was sexually harassed at a hotel cafe in December 2011 (March 2018), Congressman Jeong claimed that “there was no fact of molestation” and in a press conference, “ whopper. It was a condemnation of the people.”

Right after the report was reported in March 2018, former lawmaker Jung sued the prosecution for spreading false information, and then dropped the complaint when the details of the card used at the hotel were confirmed. Pressian also sued Congressman Jeong Jeon for defamation by publications. The prosecution turned it over to trial, alleging that former lawmaker Jeong had spread false information for the purpose of electing the mayor of Seoul.

The second trial judge said, “If the victim A’s statement is followed, the act of the defendant (Jeong Bong-ju) at the time will be the level of a so-called surprise assault that failed. However, it is questionable whether the objective act of the defendant at the time can be clearly identified as a sexual harassment in legal evaluation.”

The judge said, “The issue of this case is whether or not the defendant made false statements against memory even though he had committed an act that could be a problem at that time.” “(To prove the allegation), Although he was clearly aware of the fact that he had committed similar acts, he judged that he could avoid the situation of raising suspicions against him by using the fact that the contents of the initial report by the media were unclear.He held a press conference, etc. The premise is whether it has changed.”

Subsequently, the judge explained that “we judged that the data were insufficient as to whether the defendant’s intention was to proceed in this way.”

The judge said, “As a result, when in doubt, the sentence is made under the principle that it is judged in the interests of the defendant, and this judgment is made.”

After the trial, Congressman Jeong Jeon made a complaint. He said, “In the midst of the trial, I received a call saying that I would like the Democratic Party to participate in the contest. I haven’t been in politics for nine months, but I would like to thank the members of the Open Democratic Party for recommending me a lot.”

On the 12th, the Open Democratic Party announced on the 12th that “As preliminary candidates for the mayor of Seoul, Kim Jin-ae and two former lawmakers Chung were finalized and decided to proceed with the contest.”
