Korean Intellectual Property Office establishes standards for granting patents in new digital industries

The Korean Intellectual Property Office announced on the 18th that it has established the’standards for granting patents in new digital industries’ to help Korean companies secure high quality patents and create future growth engines.
The field of artificial intelligence (AI) provided guidelines for preparing specifications for obtaining high-quality patents, as well as criteria for granting patents by type and specific judgment cases.
The Internet of Things (IoT) service field has sufficient characteristics and effects of each service field of the invention to encourage companies to enter the market and to avoid the irrationality of applying the existing manufacturing-based patent grant criteria to information and communication technology (ICT) convergence technology. The standards have been adjusted to take into account.
In the case of seeds improved using CRISPR gene shearing technology in the seed industry, the standards were relaxed so that the applied crops could be protected by patents if there were new effects, and the guidelines for writing specifications and best practices were suggested for applicants.
The bio field complemented the standards for the development of new drugs based on artificial intelligence, which had been unclear so far, so that companies could use artificial intelligence to establish an optimal patent application strategy for each stage of development of drug re-creation technology.
In addition to the existing five core fields this year, the JPO is planning to discover additional digital new industries with high growth potential, such as autonomous driving, intelligent robots, and cosmetics, to provide customized patent grant criteria that companies need.
