The increase in the limit of futures for agricultural and fishery products under the Kim Young-ran Act (Solicitation Prohibition Act) is always a matter of controversy. According to the government and the agricultural and fisheries industry on the 3rd, the National Agricultural Cooperative Federation, the National Fisheries Cooperative Federation, and the National Forestry Cooperative Federation delivered a joint recommendation to the National Rights Committee on the 15th of last month urging the upper limit on agricultural and fishery products to be raised.

On the same day, the Korean Federation of Agricultural Entrepreneurs (Nongyeon Han), a group of farmers, publicly proposed to revise the enforcement ordinance of the Solicitation Ban Act through the National Newspaper, a national participation portal operated by the Kwon Ik Committee. The amendment contains the contents of raising the futures price of agricultural and livestock products from 100,000 won to 200,000 won under the Solicitation Prohibition Act during the Lunar New Year and Chuseok holidays.

Currently, the Solicitation Ban Act restricts the value of futures for agricultural and livestock products to 100,000 won. Although the intent is to avoid expensive gifts for an innocent society, farmers and fishermen are appealing that the consumption of our agricultural and livestock products is limited, which makes management difficult.

As consumption contracted last year due to Corona 19 and it was impossible to visit their hometown, the Kwon Ik Committee temporarily increased the gift price to 200,000 won only on the Chuseok holiday.

The Kwon Ik Committee maintained the position that it was necessary to consider legal stability and social consensus regarding requests for an increase in the value range of futures from industries and related ministries that have suffered economic difficulties. However, he explained that the price range of the gift was temporarily adjusted due to the serious difficulties of the agriculture and fisheries industry, such as visits to the Chuseok hometown, refraining from visiting the grave, and the occurrence of typhoon damage according to the Corona 19 situation and quarantine measures.

Targets include agricultural and marine products such as Korean beef, fish, fruits, flowers, and processed agricultural and marine products (products processed using more than 50% of agricultural and marine products as raw materials and ingredients, red ginseng, salted fish, kimchi, etc.).

The effect was great. According to the Ministry of Agriculture, Food and Rural Affairs, sales of agricultural and fishery food gifts of eight retailers (department stores, large marts, and home shopping) increased 7% year-on-year for a month before and after the Chuseok holiday last year (September 5 to October 4).

It is analyzed that the demand for sending gifts instead of going home has increased, but the scope of purchase has expanded due to the limit on the value of gifts under the solicitation ban. In fact, by price point at the time, the number of futures exceeding 200,000 won increased 20.0% compared to the same period last year. It was found that futures sales of livestock products such as Korean beef (17.7%) and seafood products such as gulbi and okdom (29.3%) increased significantly.

Agriculture and Food Minister Kim Hyun-soo also met with reporters before Chuseok on September 28 of last year and evaluated the increase in the upper limit of gifts under the Solicitation Ban Act, “the increase in sales of livestock products, fruits, and processed products had an effect of boosting demand.” The Kwon Ik Committee selected a case in which the price range of agricultural and fishery product gifts under the Solicitation Ban Act was temporarily adjusted as an active administrative best practice last year.

Enforcement decree needs to be revised, the agricultural and fishery industry “must prepare as soon as possible”

As the effect of raising the futures price was proved last Chuseok, the agricultural and fishery industry is in an atmosphere that demands an increase in the limit every holiday. They pointed out that there was not enough time to respond to futures price adjustments, considering that companies usually complete the composition of futures a month before the holiday.

Adjusting the futures value range requires several steps. This is because the Enforcement Decree of the Solicitation Ban Act must be revised. First of all, the revision of the enforcement decree must be decided by the all committee of the rights and interest committee, and the resolution of the State Council must also be obtained.

The agriculture and fishery industry argues that this year, the value of the gift should be increased in advance of a month or more before the Lunar New Year holiday (February 11-14). In addition, in order to resolve uncertainties, it is a position that the futures price should be raised every holiday.

An official from the Hannong Research Institute said, “Due to changes in the environment and conditions, such as the expansion of the agricultural and livestock market, consumption of domestic agricultural products continues to decrease, and the dependence on the holiday stock market continues to increase.” I expected it.”

The Kwonik Committee is still in a cautious position. Meanwhile, at the end of last year, the Kwon Ik Committee distributed promotional materials related to the’Prohibition of Solicitation Act’ gift to help people understand.

According to the Korea Rights Commission, the Prohibition of Solicitation Act applies only when the recipient is a public official (Subparagraph 2 of Article 2 of the Prohibition of Solicitation Act), so there are no restrictions on gifts exchanged between ordinary citizens such as parents, siblings, and friends.

Even if the recipient is a public official, a gift that exceeds 50,000 won (up to 1 million won at a time) is also possible if it is not related to the job. However, if there is a job-related relationship, only a gift of 50,000 won or less (100,000 won for agricultural and fishery products and processed agricultural and fishery products) is required.

Yoon-joo Lim, director of corruption prevention at Kwon Ik-Com, explained, “The Prohibition of Solicitation Act does not prohibit all gifts, and it is possible to exchange and receive gifts with a heart with precious people within the scope of value.”
