The Game Industry Association said in its opinion, “(The whole amendment to the Game Act) is an unclear concept that hinders the predictability of business operators and enforces obligations by creating a number of new provisions that did not exist.” Insisted.

At the same time, the association commented that it was “a bill that excessively violates the freedom of business and has no effect or is unlikely to be realized.”

In particular, the game industry expressed strong opposition to regulations related to probability-type items through the association’s opinion.

The whole amendment to the game law contained the first legal definition related to probability-type items and that game companies must disclose the probability of drawing items.

The current game industry’s self-regulation is transferred to the law as it is.

However, experts observe that if the concept and type of probability-type items are specifically included in the law, game companies should disclose the probability of drawing items more transparently than now.

In its opinion, the association argued that “balance, such as limiting high-end items to a certain percentage, is one of the most essential parts for the fun of the game” and “a representative trade secret managed by business operators by investing considerable expenses and researching it.” did.

At the same time, the association said, “Current probability-type items have a’variable probability’ structure, so the probability always fluctuates according to the user’s game progress, and there are many cases where the probability is not accurately known even by developers and operators.

The game is played differently for each user, but it is difficult to disclose the probability because the probability-type item is currently designed so that the probability of supplying the item varies according to the progress of each user.

The association commented, “It is not feasible to provide the probability of supplying items for each user to more than hundreds of thousands of users,” and “The definition of probability-type items specified in the amendment is also unclear and hinders the predictability of operators.”

The association added that the provisions to the effect that game advertisements should not promote speculative behavior are also somewhat unclear and the targets of new regulations such as designation of domestic agents are unclear.

The association argued that the amendment to the game law is expected to hold back the development of the game industry, and that it is considered to be unconstitutional.

In a press release, the association said, “In line with the rapidly changing game environment, we expected a law amendment that fits the reality, but the reflection of on-site opinions is insufficient.” I am concerned that there will be an impact.”
