Supreme Court Chief Kim Myung-soo is on the morning of the 5th to work at the Supreme Court in Seocho-gu, Seoul.

On the 5th, amidst the spreading controversy about the false clarification of the impeachment transaction of Supreme Court Chief Kim Myung-soo, on the 5th, impeachment of Supreme Court Chief Kim Seong-geun, who released a recording of the conversation with Chief Justice, said, Raised his voice.

In a statement that day, 140 members of the 17th Judicial Research and Training Institute said, “An impeachment proceeding was carried out against a first-line judge in the constitutional ideology,” and “for the act of acknowledging that he is not a guilty in criminal trial. He pointed out that it was an impeachment proceeding against the front judges.”

He added, “The parliamentarians of the criminal passport have been committing profane legislative acts using the dominance of numbers,” he said.

They criticized, “With such a logic, the impeachment of Chief Justice Kim Myung-soo should precede,” he said. “As the head of the court, instead of protecting the judge he was supposed to protect, he thrown him into a whirlwind of impeachment.”

He added, “(Chief Chief Kim) gave up the judiciary’s independence because he was in a hurry to see the politicians’ attention,” he added. “This action undermined the authority of the court and made many judges feel shame and self-destruction.”

All the 17th graders raised their voices saying, “The person who should be impeached is not Judge Seong-geun Lim, but Chief Justice of the Supreme Court Kim Myung-soo.”

“I don’t think that what Judge Im did was a good thing, but the responsibility for the wrongdoing should correspond to that level.” It is clear that it is an unconstitutional abuse of authority that violates independence.”

“This impeachment is related to the law and related to our 17th classmates, so we first think that Nasom is valid.” “I look forward to the general public, including legal professionals other than the 17th, with us.” I finished writing.

Meanwhile, civic groups are also continuing their offensive against Chief Justice Kim for the second day.

The solidarity of action to raise the rule of law (law sophistication) argued that “because it is a clear violation of the independence of the judiciary and political neutrality, we must immediately resign.” The Judicial Examination Preparatory Group also issued a statement and said, “Except for Chief Justice Kim Myung-soo, the members of the judiciary together ask that the members of the judiciary do not give in to the fear of the Democratic Party and make a judgment in accordance with the laws and principles.”

Supreme Court Chief Kim, who bowed his head saying, “I apologize for the apology and apologies,” on the way home from work the day before, was firmly shut to the reporter’s question about whereabouts on the way to work at the Supreme Court building in Seocho-gu, Seoul.

Our position on the impeachment of Judge Seong-geun Lim

On February 4, 2021, an impeachment proceeding against Judge Im Seong-geun, the head of the Busan High Court, was passed with 179 votes in the approval of the members of the parliamentary law. Impeachment proceedings were made against the first judges in the constitutional history. The reason for the impeachment is that Judge Seong-geun Lim committed an unconstitutional act of intervening in the trial of another judge.

However, the court has already sentenced Judge Im not guilty to the act of impeding the exercise of the right to abuse of authority. For the act of acknowledging that he was not guilty in the criminal trial, the congressional lawmakers impeached the first line judge in constitutional history. Meanwhile, Judge Seong-geun Lim has already announced his intention to resign, and is scheduled to retire at the end of February due to expiration of his term. Long ago, he expressed his gratitude and, regardless of him, attempted to put a snare of impeachment, even though his term of office expired after only 20 days.

Is the reason why pan-passport lawmakers are trying to impeach Judge Seong-geun Lim from the patriotic sense of mission that it is absolutely necessary to keep the constitutional order of the country? Or is it dissatisfied with some recent rulings and attempting to tame the judiciary? We judge that the latter is obvious.

Pan-Passport lawmakers have used the number dominance to commit profane legislative acts. Political forces and the majority of the people who have different views from them have taken an attitude that seems to be out of mind. They are elected, and judges who are not elected dare not to think about it.
With such a logic, the impeachment of Chief Justice Kim Myung-soo should precede. Rather than protecting the judge he had to defend as the head of the court, he was thrown into a whirlwind of impeachment. In a hurry to see the politics, he gave up the independence of the judiciary. He has only acted for himself. He even lied to deny the conversation with Judge Lim, as the chief justice of the country. When the recording file was released, it was consistent with excuses, such as that the memory was not accurate because it was old. These actions undermined the authority of the courts and caused many judges to feel humiliated and self-defeating. The person to be impeached is not Judge Seong-geun Lim, but Supreme Court Chief Kim Myung-soo.

We don’t think that Judge Seong-geun Lim’s actions were good. However, the responsibility for the fault should correspond to that degree. Judge Seong-geun Lim’s actions do not remarkably reach the grounds for impeachment. Therefore, it is clear that the substance of the impeachment prosecution stems from the political purpose of taming the courts and establishing the position of criminal passport, and is an unconstitutional ex officio abuse that violates the independence of the judiciary.

Since this impeachment is related to the law and related to our 17th classmates, we first think that Nasom is valid. However, since this is not a problem that is limited to us, it is related to the entire legal law and even the entire country, we expect that the general public, including those in the 17th period, will also join us.
