During the April 15 general election last year, prisoners were sentenced to prison terms for members of the Hwang Unha election camp, accused of illegally using party member personal information during the Democratic Party’s primary election.

The 11th Criminal Division of the Daejeon District Law (Judge Yong-chan Kim) was imprisoned for violation of the Public Officials Election Act by A (51), former secretary general of the Democratic Party Daejeon Jung-gu Regional Committee, sentenced to two years probation in October and sentenced to prison for violation of the Personal Information Protection Act in June. Each of them was sentenced to one year of probation.

Mr. B (56), an incumbent member of the Daejeon Jung-gu council, accused of violating the Public Official Election Act, was sentenced to two years of probation in October. The judge ordered Mr. A and Mr. B for 80 hours of community service. Mr. B loses his position as a member of the lawmaker when this sentence is confirmed.

Court says, “It is necessary to sound an alarm for illegal contest”

The judge ruled, “In a situation where all the Democratic Party’s dominant results were found in the public opinion polls, we had to strictly observe the contest method,” and “it is judged as a case that needs to sound an alarm for the illegal contest.”

“The defendant provided the personal information of others to the election offices he supported and used them for illegal contests.” He said, “Mr. B, as an incumbent council member, had to pay more attention to comply with the Public Official Election Act, but he did not.” Stated the reason.

A was charged with using the rights party’s personal information to appeal for the support of the Hwang Unha preliminary candidate at the time, without consent, during an intra-party primary to decide the Democratic Party candidate Jung-gu, Daejeon. Mr. B was also accused of making a phone call asking party members to support Hwang Unha’s preliminary candidate.

Defendants claim “I didn’t know it was illegal and there was no conspiracy”

During the trial, they said, “It is true that they appealed for some support, but the scale was not large and they did not know whether it was illegal. There were no plans and conspiracy”, but the court did not accept it. In response to the revision of the Public Officials Election Act in December of last year, despite the defendants’ refutation that it was not illegal to conduct a contest over the phone or face-to-face, the court emphasized that “we cannot cover the guilt for the offense before the amendment.”

At the decision trial held on December 24 last year, the prosecution said, “This crime, which the two conspired, had a significant impact in the process of the contest, and the result was extended to the final election.”

Earlier, the prosecution confiscated and searched the election camp for Hwang Unha on April 24 last year, and arrested Mr. A on July 17. At the time, Rep. Hwang said, “It is not an investigation directly against me. Even if a crime is established, of course, I have nothing to do with the camp.”

According to the Election Commission, the election crime of a camp official who is not in charge of accounting, unlike the act of donating or violating the illegal receipt of political funds, does not fall under the case of’invalidation of candidate election’ pursuant to Article 265 of the Public Official Election Act.
