The second division of the Supreme Court (Presiding Judge Kim Sang-hwan) announced on the 14th that it has confirmed the court case of sentenced to 1 year and 6 months imprisonment and 7 months imprisonment for Mr.
Mr. Roh was the head of a social enterprise center established for the purpose of free meal service, and was entrusted with the execution of a social service order from the Incheon Probation Office.
In March 2018, Mr. Shin received a request from Mr. Shin, who is subject to a social service order, to “don’t do social service because I’ll use money,” and from March 8 to April 2 of that year, Shin went to work and ordered social service. He was charged with making false reports as if he had fulfilled.
Mr. Noh falsely entered the service start time, attendance photo, leave time, and leave photo 15 times on the computer network installed to remotely supervise those subject to social service orders and transmitted them to the competent probation office.
During the social service period, Mr. Shin took a picture of his attendance and then immediately left the center and spent time at a nearby coffee shop and residential area. At around 1pm and 6pm, he took’intermediate inspection pictures’ and’commission pictures’ and entered. The actual washing, cleaning, delivery, etc. was not done.
Roh received a fake luxury briefcase and 10 pounds of beef worth 150,000 won in exchange for the request. Shin also sent 3 million won in the name of a donation to the account in Mr. Roh’s name.
The first trial judged that Mr. Roh accepted Shin’s request and received the goods in return, as a result of a reconnaissance. Mr. Roh claimed that he received it as a result of his close relationship with Mr. Shin, but the court refused.
However, although Shin’s 3 million won to the center was treated as an auxiliaries payment, he did not admit the crimes of surrendering or reincarnation by Mr. Roh and Shin as he judged that the donation to the center was correct. Although it is Mr. Roh’s personal account, the possibility of donating to the center other than Mr. Roh’s personal account cannot be ruled out.
The second trial and the Supreme Court also decided that the ruling was correct.
