Accordingly, the parents of Ms. A visited the Korea Legal Aid Corporation for help, and the court ruled that even if the dog did not bite a passerby, if the dog was injured by the threat, Gongju should compensate for mental damage as well as medical expenses.

Judge Choha Kim of the Changwon District Law said, “The dog ran and Ms. A was injured while trying to avoid it, and Ms. A is an 8-year-old child, but the dog’s dog is an adult dog, whose size is about the knee of an adult. It can pose great dangers and fears to anyone other than the owner.” In addition, if he finds a dog that suddenly rushes, it is a general reaction that he can’t do any defensive actions and sits down in surprise.

Accordingly, Judge Kim ruled that Ms. A’s treatment expenses of 2.66 million won and alimony of 3 million won should be compensated by the dog.

“Even though it was not a case that caused direct physical damage such as biting or scratching a dog, it was recognized not only hospital expenses, but also mental damage,” said Sung-Hoon Jeong of the Legal Aid Corporation, who acted on behalf of the lawsuit. You need to be careful.”
