The court sentenced a jail sentence to a woman in her 30s who assaulted a security guard in her 70s for’the breaker did not open in time’.
According to law enforcement officials on the 21st, Judge Bae Ye-seon, who was the only criminal 5 of the Bucheon Branch of the Incheon District Court, sentenced A (36, female), who was imprisoned for special injuries and other charges, to 1 year in prison and held in court. Mr. A was accused of assaulting security guard B (74, male) with a mobile phone and fire extinguisher at an officetel in Bucheon, Gyeonggi-do last May.
It was investigated that Mr. A went to the security office when he tried to enter the parking lot and the barrier did not open, and took B’s forehead down with the corner of his mobile phone. Later, he hit B’s shoulders and hips with a fire extinguisher next to him and kicked his thighs with his feet.
Mr. A, who was being investigated by the police for this case, also assaulted Mr. B a month later. It was at the spot where Mr. B met B while looking for the security office to pay the parking fee. At the time, when Mr. B asked, “Do you not say apologize for being sorry?”, Mr. A kicked B’s thigh, saying, “Guard X-child, I want to meet you again.”
The court dismissed the prosecution for Mr. A’s assault charges as Mr. B said he did not want punishment. Under the criminal law, the crime of assault is a crime against intention that the victim cannot punish the perpetrator if they do not want to.
The judge said, “Even though the accused was angry with the victim, who was in the position of the socially underprivileged, and showed so-called’grumpy’ behavior, he did not truly reflect on or repent of his wrongdoing.” Revealed.
“The defendant submitted an agreement stating that’the victim does not want punishment,’ but the sentence element’no punishment’ is meaningful in the case that the defendant regrets the crime. He revealed the reason for the sentence, saying, “We cannot avoid the sentence of imprisonment just because it was submitted to.”
