The first hearing of the Constitutional Court on the impeachment prosecution of Busan High Court Chief Judge Im Seong-geun will be held on the 26th. It is the first time in the history of a constitution that an incumbent judge is being judged for impeachment.

On the 17th, the constitution announced that the deadline for the preparation procedure for the impeachment trial of Judge Lim will be held on the 26th at 2 pm at the Constitutional Sub-trial. On the 4th, the constitution received a resolution for impeachment prosecution from the National Assembly and initiated a hearing by the all-in-one court. Judges Lee Young-jin and Lee Mi-seon, along with Constitutional Judge Lee Seok-tae, the head judge for the impeachment trial, were designated as’Life Judges’ who intensively review the case records and proceed with the preparatory procedures. Three attorneys Hong-seok Yang, Mi-yong Shin, and Myung-woong Lee were appointed as representatives of the prosecution members of the National Assembly who passed the impeachment bill of Deputy Judge Lim to the Constitution. 155 attorneys, including Lee Seok-yeon, former head of the Legal Affairs Division, volunteered to defend Judge Lim.

Constitutional judges are expected to hear the arguments of both the National Assembly and the Deputy Chief Judge Im on the date of preparation for the pleadings, and settle the issues and evidence of the judgment in the future. It is known that it has not been decided whether Judge Lim himself will attend the pleading preparation procedure. Upon completion of the pleading preparation procedure, a full-scale impeachment trial will be initiated. On the date of the pleadings, the National Assembly and the Chief Judge Lim will be present and verbally state their opinions, and the Chief Justice may directly interrogate the Chief Justice. When all the pleadings are over, the National Assembly and the Deputy Chief Judge Lim make a final statement of their opinions, and the Constitution later makes a decision on whether the Constitutional Deputy Chief Judge is dismissed. If more than six out of nine judges approve, the impeachment is cited and Judge Lim is dismissed. If four or more judges vote negatively, Judge Lim’s impeachment will be dismissed. If there are more than 5 judges claiming that there are procedural defects in the impeachment prosecution, they may be dismissed.

Meanwhile, the term of office for Senior Judge Lim is scheduled to end on the 28th of this month. For this reason, it was raised the prospect that the Constitutional Court would make a decision to dismiss because the judge would not have any interests, as it was not possible to issue an order for the decision to cite impeachment even if there were reasons for impeachment after the deputy chief judge Lim resigned.
