A fine was confirmed for a teacher who was handed over to trial on charges of leaving a first-year elementary school student who interrupted the class alone for about eight minutes in a classroom next to what was called’hell bath.’ The 3rd Division of the Supreme Court (Presiding Judge Kim Jae-hyung) announced on the 27th that it has confirmed the court case sentenced with a fine of 3 million won to a elementary school teacher accused of violating the Child Abuse Punishment Act and the Personal Information Protection Act. In April 2019, the teacher sent the victim to a classroom next to the school called’Hell-tang’, named after a fairy tale book because the victim was not listening to and disturbing learning in the first-year classroom of elementary school. I was charged with one charge. In addition, in September of the same year, there was a suspicion of sending a text message asking for a petition in relation to the child abuse criminal complaint case against the victim student to the phone numbers of 23 parents previously kept. Accordingly, the first and second trials said, “The word’hell bath’ itself is a name that can cause fear in children, and other children in the same class also recognized it as a’place to be scolded’. It is an emotional abuse that harms children’s mental health and development. The act of sending a text message asking parents to fill out a petition was also judged that “the act was the main purpose of receiving favorable disposition from criminal punishment, so it clearly corresponds to an act that exceeded the purpose of collecting personal information”. The Supreme Court also dismissed Mr. A’s appeal, saying, “There is no mistake that influenced the judgment by misunderstanding or omission of judgment on the law on the establishment of violations of the Personal Information Protection Act and the’emotional abuse’ set forth in the Child Welfare Act.” By Jo Yoon-young, staff reporter [email protected]
