Seoul Metropolitan Police Agency concludes investigation of Park Won-soon case

The police terminated the investigation of the late Seoul Mayor Park Won-soon’s suspicion of sexual harassment with’no public prosecution’ and sent it to the prosecution as an opinion of unprosecution. After Mayor Park’s death, the police hung on the investigation for more than five months, but the investigation was ended without clarifying the actual truth about the alleged sexual harassment. On the 29th, the Seoul Metropolitan Police Agency announced the results of the investigation of the case related to former Seoul Mayor Park Won-soon. The police said, “The case of sexual harassment charges against Mayor Park will be sent to the prosecution with the opinion of the accused (no public prosecution) following the death of the accused (mayor Park).” In response to the lack of evidence to prove the crime, even the case accused of aiding forcibly harassment will be sent to the prosecution as a non-prosecution (no charge).” In the investigation of the police, a complaint was filed against Mayor Park on July 8th for violating the law of punishment for forced harassment and sexual violence. It started when it was found dead. On July 16, the police organized a “dedicated investigation TF” to investigate the death of Mayor Park and allegations of sexual harassment. The police said that in the case of Mayor Park’s suspicion of sexual harassment (violation of the Act on Compulsory Harassment and Sexual Violence), they investigated the victim and the reference person, but that it will be sent to the prosecution with an unprosecution opinion due to the death of the deceased. There was also an expectation that the police would conduct mobile phone forensics in relation to the death of Mayor Park, and the facts related to the suspicion of sexual harassment would also be revealed, but the police said, “According to the decision of the court, mayor Park’s mobile phone forensics was performed, but I could only see the information. It is difficult to confirm the details.” Regarding the history of Mayor Park’s death, the police only explained that “It is difficult to tell the specific motive of death considering the honor of the deceased and the bereaved. The police said that Park’s death was not related to a crime (a suspicion of sexual harassment), so it was scheduled to be “terminated”. Regarding the allegations of aiding sexual harassment against former and current officials in Seoul, the police said that they will investigate 26 reference persons and five accused persons, including Seoul city employees, but due to lack of evidence to prove, they plan to send them to the prosecution with an unprosecution opinion. Previously, the police applied for a seizure and search warrant twice for forensics on Mayor Park’s business cell phone in connection with the alleged assistance, but both were dismissed by the court. However, the police handed over some of the suspects accused of’second offense’ against the victims of sexual harassment, Mayor Park. The five people who circulated the victim’s’claims’ are planning to be sent to the prosecution on charges of violating the Sexual Violence Punishment Act (compliance with confidentiality, etc.). In addition, four people who are accused of violating the Information and Communication Network Act by posting malicious comments online, and six people who posted photos of people other than the victims on the Internet as victims, will be handed over to the prosecution as opinions of prosecution.
