A former sergeant Byun Hee-soo (23), who was forcibly discharged after undergoing a sex change operation while serving in the military, was found dead on the 3rd at his home in Sangdang-gu, Cheongju, Chungcheongbuk-do. He hoped to continue serving in the military, but the Army decided on mandatory military service in January last year after making a decision of Level 3 mentally and physically impaired, and referring it to the discharge committee. At the time, Sergeant Byeon filed a petition with the Human Rights Commission on January 20 last year, two days before the discharge review, and also filed an emergency relief request requesting the suspension of the unfair discharge review. The Human Rights Commission made an emergency relief decision on the 21st, the next day, and recommended the Army Headquarters to postpone the holding of the evaluation committee for three months, but the Army conducted a discharge review. Sergeant Byeon filed an administrative lawsuit against the army. On December 14, last year, the Human Rights Commission held the All-in-One Committee and recommended that the Army’s compulsory warfare measures constitute human rights violations and to cancel the disposition to the Army Chief of Staff. In addition, the Minister of Defense recommended that the related system be reorganized so that such cases of damage do not recur. In its decision, the Human Rights Commission pointed out that the army’s decision violated the freedom of job performance. “The army arbitrarily interpreted the sex change surgery as a requirement for mental and physical disability and dispose of the victims.” He also pointed out that “there is no basis for seeing that the health status of Sergeant Byeon is’unsuitable for active duty’.” Tae-hoon Lim, director of the Military Rights Center, said, “Today, a transgender soldier, former Sergeant Byun Hee-soo, has passed away.
