Ericsson filed another patent litigation against Samsung

Patent litigation between Samsung Electronics and Ericsson is growing.

The Phosphaters reported on the 2nd (local time) that Ericsson filed a patent infringement lawsuit against Samsung again from the beginning of the new year.

According to reports, Ericsson filed a lawsuit in the Eastern Texas District Court on the 1st, claiming that Samsung Electronics stole eight essential standard patents and four general patents without permission.

Ericsson filed a lawsuit in the same court last month saying that Samsung did not comply with the FRAND obligations of the standard patent contract. FRAND is an obligation to enter into a’fair, reasonable and non-discriminatory’ contract for standard patents.

The reason Ericsson sued Samsung from the first day of the new year was due to a patent license agreement, Phosphatants said. According to the patent license agreement signed by the two companies in 2014, they are not allowed to file patent infringement lawsuits with each other until the end of 2020.

In this lawsuit, Ericsson claimed that Samsung infringed eight essential standard patents, including’HARQ in spatial multiplexing MIMO system’ (805 patents).

In addition, it claims that it has stolen four commercial patents, including’built-in antenna for mobile communication devices (849 patent)’.

2014 Patent Mutual License Agreement… As if a dispute broke out after the period was over

Samsung and Ericsson signed a license agreement for handset and network-related patents in 2001 and an extension agreement in 2007.

However, the two companies initiated patent litigation in 2012, near the end of their second contract. When Ericsson first filed a complaint against Samsung, Samsung immediately complained and engaged in a fierce battle.

The two companies, which had been in a patent dispute for more than two years, closed the lawsuit with Samsung paying $650 million in 2014.

At the time, Samsung and Ericsson signed comprehensive mutual license agreements for all patents held up to that point and patents acquired over the next several years.

Phosphatants analyzed, “At the time, the two companies signed a 7-year license agreement, and now, as the contract ends, they seem to have entered a patent dispute again.”
