On that day, the second division of the Supreme Court (Presiding Judge Ahn Chul-sang) dismissed the prosecutor general’s emergency appeal requesting a re-judgment of the former Supreme Court ruling in 1989, in which former director Park Moo-won’s charges of special confinement were not guilty. It was in the spirit of “there was no problem with the logic of applying the law at the time.”

Yong-won Kim (66, 10th Judicial Research and Training Institute) is the protagonist of the Busan Port Law Firm, who digs into the brothers’ welfare support case in 1987 as a pyeong prosecutor of the Ulsan District Prosecutor’s Office and prosecuted former Director Park in custody. At that time, he went on a pheasant hunt with an acquaintance, and he accidentally witnessed a scene where children under the brothers’ welfare support suffered forced labor at the Ulju workshop, and informed the world of the case of brothers’ welfare support through cognitive investigations.

On this day, attorney Kim criticized the judiciary by posting a post on his Facebook page titled’The Investigation Prosecutor’s Minor for the Emergency Appeal of the Brother Uniform Support Case’.

Attorney Kim said, “The Supreme Court has never admitted or reflected on their mistakes even after committing numerous mistakes since the military regime.”

“The Korean version of Auschwitz (World War II Nazi concentration camps for Jews in the Nazis of World War II)’ was a case in which the Supreme Court Justices, who were legal bridesmaids of the Chun Doo-hwan regime, were acquitted. He said, “We maintained the innocence of special confinement (for former director Park).”

“This is because of the collective integrity of the Supreme Court Justices,” he said. “This country once again affirmed my long-standing belief that reform of the judiciary is much more urgent than reform of the prosecution.”

Attorney Kim raised his voice, saying, “Because the ruling party is completely deprived of the prosecution’s investigation, it should not make any bullshit, but must pass the fact-finding law of the past, which has regulations on compensation for damages related to fraternity support.”

According to an investigation by the Prosecutors’ Past History Committee, it was revealed that when Kim arrested former director Park, who was a maintainer in the Busan area at the time of the investigation of the brotherhood support, the prosecution’s head of the prosecution as well as political figures such as the mayor of Busan strongly pressed against him. At the time, the Busan District Prosecutor’s Office was Park Hee-tae, the former chairman of the National Assembly.

Even after leaving the prosecution, Mr. Kim has been in charge of litigation mainly to rescue those who have been victimized by prosecution investigations or unfair judgments by the court.

The prosecution’s past son-in-law recommended an emergency appeal to the prosecutor general seeking correction of the past Supreme Court ruling through a fact-finding investigation in 2018, and former prosecutor general Moo-il Moon accepted.

Last year, the Supreme Court discussed this issue through an all-in-one consensus, and the sentence was decided to pass.

Busan Brothers’ Welfare Support Case

It refers to the case of human rights violations that took place in’Brother Uniform Support’, a social welfare facility in Buk-gu, Busan from 1975 to 1987. Ahead of the Asian Games in 1987 and the Seoul Olympics in 1988, the Chun Doo-Hwan government ordered bums to be accommodated in facilities according to the’urban cleanup project’. This was accepted. Many of them were forced into prison by the police against their will, and it was found that forced labor, beatings, abuse, murder, and black burial occurred frequently. The official death toll was 513.
