Disguised marriage, disguised transfer, and illegal real estate subscription detected

197 cases in the first half of last year, commissioned

The Ministry of Land, Transport and Maritime Affairs discovered and investigated 197 suspected cases of fraudulent subscription, such as disguised transfer, subscription passbook sales, and transfer of subscription qualifications, and 3 suspected cases of illegal supply by business entities, as a result of on-site inspection of illegal subscriptions conducted on pre-sale housing complexes in the first half of 2020. He said he requested.

In this field inspection, 197 cases of fraudulent subscriptions were 134 cases of disguised transfer by type, 35 cases of subscription passbook sales, 21 cases of transfer of subscription qualifications, and 7 cases of disguised marriage and disguised marriage. In addition, the situation in which the business entity illegally supplied a total of 31 houses at three sales sites, such as deliberately winning an ineligible additional point system or voluntarily supplying the remaining amount due to ineligibility or abandonment of contracts, was also discovered during this inspection process.

The Ministry of Land, Infrastructure, and Transport commissioned an investigation at the end of December on 197 suspected cases of illegal subscription and 3 cases of suspected illegal supply.

Depending on the results of the investigation, violators are punished by imprisonment for not more than three years or a fine of not more than 30 million won. In addition, the housing supply contract signed by the violator will be canceled, and the qualification to apply for subscription for the next 10 years will be restricted.

“We will take strict measures against fraudulent subscriptions that threaten the soundness of the housing market and reduce the chances of homeless end users who are desperate for homeownership through active and regular crackdowns,” said Han Seong-soo, head of the Ministry of Land, Infrastructure and Transport. Particularly, if the subscription passbook and subscription qualification are transferred and participated in illegal subscription, criminal penalties, contract cancellation, and restrictions on subscription qualifications, as well as persons with disabilities or basic beneficiaries may be deprived of the resident status of public rental housing or the right to receive various social security benefits. There is a possibility that additional damage may occur, so special attention is required.”

On the other hand, the Ministry of Land, Infrastructure and Transport has initiated an on-site inspection of illegal subscriptions and illegal supply targeting 24 sales complexes (5 metropolitan areas, 19 local areas) from December 29 to the second half of 2020. With regard to this suspected complex, we plan to eradicate disruption to the supply order through regular inspections, such as immediately commencing on-site inspection.

In addition, it requested local governments across the country to enforce strong crackdowns on illegal subscription and illegal supply practices, strengthen guidance and supervision of business entities, and strengthen business entities’ self-cleaning efforts through housing associations.
