Court “Seoul Office of Education Violates the Cancellation of Sehwa·Pay Stock Highs”

The court determined that it was illegal to cancel the designation of an autonomous private high school by the Seoul Metropolitan Office of Education.

On the 18th, the 14th administrative division of the Seoul Administrative Court (Deputy Judge Sang-hoon Lee) ruled that the plaintiff won a lawsuit against the Seoul Metropolitan Superintendent of Sehwa and Baejae High School for cancellation of the designation of an autonomous private high school. Accordingly, Sehwa·Pae Inventory maintains its own high status.

In July 2019, the Seoul Metropolitan Office of Education decided to cancel the designation of eight private high schools in Seoul, including Kyunghee, Baejae, Sehwa, Sungmun, Shinil, JoongAng, Idaebu High School, and Handaebu High School, for lack of performance evaluation score, and the Ministry of Education approved it. Was raised.

Paijae·Sehwa High School has argued in court that the change of evaluation criteria for redesignation of own high schools by the Office of Education has been procedurally problematic, and the criteria for evaluation items are arbitrary and ambiguous, so the cancellation of designation is invalid.

On the other hand, the Office of Education adhered to the position that the evaluation items and the change criteria were carefully considered and sufficiently informed. Prior to the main lawsuit, all eight schools’ applications for suspension of execution were accepted.

On the other hand, the ruling against private high schools in Seoul was the first time, but in Busan last December, Haeundae High School won a lawsuit against the Office of Education’s cancellation of its designation.

After the sentence, Sehwa High School principal Kim Jae-yoon said, “I thought this would be the result,” and said, “The school is going to continue its original educational activities without worrying about it.”

Principal Bae Jae-go, Ko Jin-young also said, “I am very pleased that Bae Jae High and Sehwa High have regained their status,” and said, “We will continue to provide the best education that can be done by self-accident.”
