During the 2015 Korean-Japanese government’s consensus on comfort women, a court judged the Ministry of Foreign Affairs to disclose records of interviews with the Democratic Party lawmaker Yoon Mi-hyang, who was then the standing representative of the Korean Council for Countermeasures against Mental Problems (Jung Dae Hyup).

On the 10th, the 11th administrative department of the Seoul Administrative Court (Director Hyung-soon Park) ruled on the 10th that the conservative bar organization’Aggregation of Lawyers for Human Rights and Reunification of the Korean Peninsula’ (Hanbyon) filed a lawsuit against the Ministry of Foreign Affairs for refusing to disclose information.

The judge said, “Excluding all sensitive matters such as specific diplomatic consultations, etc., should be disclosed.” “The documents judged for disclosure are the result of interviews between officials of the Ministry of Foreign Affairs and Representative Chung Dae-hyup, such as the date and time and the subject of the interview.” Accordingly, most of the remaining information was designated as the subject of disclosure, except for one of the five information that was rejected after Han Byeon requested disclosure to the Ministry of Foreign Affairs.

The judge said that information related to Congressman Yoon should be disclosed in terms of the people’s right to know. The Ministry of Justice said, “The information subject to disclosure is mainly related to the activities of Congressman Yoon, a public person, and does not include diplomatic sensitive matters such as specific discussions with the other country, so it does not correspond to’diplomatic relations’.” Information on public figures, such as incumbent members of the National Assembly, is more broadly subject to the general public’s right to know than ordinary people.”

In addition, the judge said, “Even if some matters on diplomatic relations are included, there is no small amount of profits that can be obtained by satisfying the public’s right to know and preventing exhausting debates on facts. The national interest in diplomatic relations that will be damaged by this is not clear.”

Earlier, in June of last year, Hanbyon requested the Ministry of Foreign Affairs to disclose data and information related to the interview, saying that △was Rep. Yoon aware of the contents of the consensus for comfort women and △the public has the right to know whether the opinions of Rep. Yoon were reflected in the agreement. However, when the Ministry of Foreign Affairs was notified of the decision of non-disclosure, it filed a lawsuit on the grounds that “if such information is disclosed, there is a risk of harming the national interests”.
