Court allows vehicular demonstrations in Section 3·1… ‘3 hours per person in 9 generations’

The court allowed a small-scale demonstration in Seoul city center with no more than 9 participants in the March 1st. This is the result of a decision that has allowed less than 10 vehicle demonstrations since last year’s Liberation Day incident.

According to law enforcement officials on the 28th, the first administrative division of the Seoul Administrative Court (Deputy Judge Ahn Jong-hwa) cited a partial request for suspension of enforcement of the ban on vehicle demonstrations made by the conservative patriot patrol team against the head of the Seoul Police Agency.

Earlier, the patriotic patrol team reported to the police that they would conduct a vehicle demonstration in Section 3.1. From 10:30 a.m. to 5:00 p.m., 10 people will use 10 vehicles, including one 5-ton truck and 9 vans, from the vicinity of Independence Gate to the vicinity of Hanseong Science High School through Tongil-ro and Gwanghwamun.

The police decided to notify the ban. The police heard that the Seoul Metropolitan Government announced the restriction on assembly of 10 or more people and that the banned area was included in the marching route.

Accordingly, the patriot patrol team applied for suspension of execution along with an administrative lawsuit. The patriot patrol team insisted on canceling the disposition, saying, “The rally was held with one person per 10 vehicles, and even though the risk of spreading the novel coronavirus infection (Corona 19) was low, protests were completely banned and the freedom of assembly under the constitution was violated. .

The court approved the demonstration in recognition of the unrecoverable damage of the organizers due to the ban and the urgent need to prevent it. The police did not accept claims that the protests had a significant impact on public welfare.

However, the number of participants in the demonstration was limited to 9 people using 9 vehicles. This was taken in consideration of the Seoul Metropolitan Government’s notice of restrictions on assembly of 10 or more people. In addition, the use of 5 ton trucks was also restricted due to obstruction of traffic flow.

The time allowed for demonstrations was from 11 am to 2 pm in consideration of traffic conditions in the Jongno and Gwanghwamun areas. Also, they were told not to do any face-to-face meetings or contact before or after the meeting.

Meanwhile, the Seoul Administrative Court issued a decision on the 26th to allow only small-scale gatherings of 20 to 30 people out of many outdoor gatherings in downtown Seoul during the March 1st.
