Controversy over the controversy over Chinese top actress surrogate mother

Global Times Can’t Punish Surrogate Mother Under Chinese Law… Law blind spot
Imprisonment for up to 5 years is possible if the child is abandoned

[아시아경제 베이징=조영신 특파원] Mainland China has been overturned by the problem of surrogate mothers for top Chinese actresses.

According to the Hong Kong South China Morning Post (SCMP) on the 20th, Chinese top actress Jung Shuang (30), who became a stardom with the 2009 Chinese version of “Boys over Flowers” series, “Ilgi Raegan Yoo Seong-woo”, is a boyfriend producer Jang Heng. It was revealed that she tried to have two children in the United States through a surrogate mother between her family, but she broke up with Jang Heng before the children were born, and the children were also abandoned.

Zhang Heng said in a post on Weibo (Chinese version of Twitter) on the 18th that he and his family were unable to come or go from the United States due to the problem of caring for two young children.

A friend of Zhang Heng also provided documents to the Chinese media about a baby boy born on December 19, 2019 and a baby girl born on January 4, 2020.

He also unveiled a recording of the conversation between Jeong Shuang, Zhang Heng, and their parents about what to do with the children who were still in the surrogate mother’s stomach. In the dialogue, Jeong Shuang’s father insisted that the children be thrown into the hospital, but Zhang Heng’s father objected that it was illegal.

In addition, Jung Shuang was annoyed at the situation where his surrogate mother could not have an abortion after 7 months of pregnancy, and Jung Shuang’s family suggested the adoption of the children. When this fact was revealed, Chung Shuang became the hottest topic in China online on the 18th to 19th.

China’s state-run Global Times also covered an article titled “Chinese actresses give up surrogate mother babies in the United States.” He said that the model contract with Italian luxury brand Prada was terminated due to the surrogate mother problem.

British jewelry brand Laura Rose and fashion magazine Harper’s Bazaar also immediately deleted posts related to Jeongsop online, the Global Times reported.

The Global Times explained that there is a great controversy in China, with waivers related to Zheng Shuang’s surrogate mother being viewed 4.6 billion times.

As the controversy grew, it even went to the Political and Legal Committee of the Central Committee of the Communist Party of China. The Political Justice Committee has clearly pointed out that she is not innocent by exploiting a legal loophole.

China attorney Zhang Jing explained, “It is illegal in China, but if you have a child in a country where surrogate mothers are allowed, you cannot punish them under Chinese law.” There is a blind spot in Chinese law.

However, he added that Zheng Shuang’s abandonment of children could be punished by Chinese law. It added that the Chinese penal code could impose a sentence of up to five years for failure to fulfill its obligations to support the elderly, the elderly, the minor, or those who cannot live independently.

The Global Times pointed out that the surrogate business is prospering, taking advantage of the loopholes of Chinese law. Every year, 2,500 to 3,000 children are born through Ukrainian surrogate mothers, and a third of them are Chinese children. It also added that the cost of the surrogate mother was USD 50,000 (about 55 million KRW).
