According to the legal community on the 13th, the Seoul High Court Criminal Division 3 (Judge Bae Joon-hyun, Ph.D. Kim Gyu-dong) was charged with retaliation threats, property damage, building intrusion, business obstruction, threats, defamation, and insult under the Aggravated Punishment Act for certain crimes. Like the first trial, he was sentenced to two years in prison.
Mr. A was arrested on charges of interfering with the school’s work, such as intruding into the Go Academy operated by Joe 9 Dan for about a year from April 2019, scribbles on the walls of the building, yelling, etc.
In particular, in April of last year, he went to the academy for 3 consecutive days and screamed “(Jo 9 Dan) is going to marry me”, spreading false facts and harassing him. There is also a suspicion of threatening with malicious comments such as’wait for this.’
In response, 9 Dan sued Mr. A to the police in April of last year. After completing the police investigation in the same month, it turned out that Mr. A went to the academy and threatened Joe 9 Dan, saying, “I will kill you” and “Come out immediately.”
The court of the first trial said, “The crime was not good enough to hire a private bodyguard because I felt the victim’s psychological shock and anxiety that they were not properly protected by the criminal justice process.” There aren’t many,” he exclaimed. However, the sentence was decided in consideration of the fact that A had a record of being treated for schizophrenia.
The prosecution appealed that the sentence was too light to be unfair, but the court of appeals court did not accept it, saying, “The defendant came to the appeal trial, and the defendant admitted to the crime and reflected on it, and mental illness, such as suffering from schizophrenia for a long time, seems to have caused the crime.”
