A man in his thirties who raped his stepdaughter dozens of times was sentenced to medium sentence even at an appeal trial.
The first criminal division of the Gwangju High Court Jeonju Tribunal (Deputy Judge Seong-ju Kim) dismissed the defendant’s appeal in an appeal against Mr. A (35), who was accused of violating the sexual protection law of children and adolescents (adultery such as hierarchies), and was imprisoned for 10 years. A 120-hour sexual violence treatment program was completed, personal information was disclosed and notified for 7 years, and employment restrictions were maintained at institutions related to children and adolescents and welfare facilities for the disabled for 10 years.
Mr. A was accused of sexual assault on his stepdaughter B (a teenager) 86 times in about two years from August 2018.
It was investigated that Mr. A committed the crime using the sentiment of Ms. B, fearing that he would be hated by his mother if there was a disturbance in the family due to his resistance.
However, Mr. A denied the charges, saying, “My daughter agreed and had sex.”
The first trial court said, “The victim was worried about who could properly take care of his younger siblings if there was a problem with the defendant even in this situation,” and said, “There is a need to severely punish the accused who raped over a long period of time using the victim’s kindness He pointed out, and sentenced him to 10 years in prison.
The Court of Appeals also said, “The defendant appealed to the investigative agency on the grounds that the part that was surrendered to the first trial was not reflected in the first trial, but according to the Supreme Court case, it does not matter even if the court did not take that part into account. It can not be said that the risk of recidivism is low and there is no change in the terms of the sentence, so the sentence of the first trial does not look too heavy.
